AN ORDINANCE AUTHORIZING A SPECIAL USE TO PERMIT RETAIL SALES
AND CUSTOMER SERVICE USES AS ACCESSORY TO A PRINCIPAL WHOLESALE USE
WHEREAS, the Plan Commission of the Village of Deerfield has heretofore
held a public hearing on the application of THE FIRST NATIONAL BANK OF LAKE
FOREST as Trustee under Trust No. 4718 (herein referred to as "Applicant ") for
approval of a Special Use to permit retail sales and customer service uses as
accessory to a principal wholesale use on the premises legally described in
Exhibit A, attached hereto and made a part hereof, under and pursuant to the
provisions of Articles 6.2 -3,3a, 6.2 -3,4a, 13.4 -2,2 and 13.11 of the Zoning
Ordinance of the Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published notice thereof
and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield, after considering
the evidence adduced, made written findings of fact and recommended that the
Special Use as proposed be approved and authorized subject to certain condi-
tions and restrictions hereinafter set forth; and
WHEREAS, the President and Board of Trustees of the Village of Deerfield
have determined that the best interests of the Village of Deerfield will be
served by the approval of the Special Use in accordance with the testimony and
documentary evidence presented by Applicant to the Corporate Authorities.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the President and Board of Trustees do hereby affirmatively
ONE: find that the Special Use' as proposed by Applicant fully complies
with the requirements and standards set forth in Article 13.11 -4
of the Zoning Ordinance of the Village of Deerfield and the Special Use of the
real estate, as and for purposes of retail sales and customer service uses as
accessory to a principal wholesale use be and the same is hereby authorized
and approved subject to the conditions hereinafter set forth.
SECTION That the approval and authorization of said Special Use hereby
TWO: granted is subject to compliance by Applicant with all other
applicable codes and ordinances of the Village of Deerfield.
SECTION That any violation of the condition hereinabove set forth shall
THREE: authorize the revocation of the Special Use hereby authorized.
SECTION That the Village Clerk is hereby directed to publish this
FOUR: Ordinance in pamphlet form.

PARCEL 1: That part of Lot 5 in Phileman Cadwell's Addition to the Town
of Deerfield (said addition being a part of the North West quarter of
Section,33, Township 43 North, Range 12, East of the Third Principal
Meridian) and of the North East quarter of the North East quarter of
Section 32, Township and Range aforesaid, bounded by a line described
as follows, to-wit: Commencing at a point on the Easterly line of the
Depot grounds of the Chicago, Milwaukee, St. Paul and Pacific RailVay
Company 311.40 feet Northerly of the intersection of said Easterly
line of the Depot grounds with the North line of Osterman Avenue;
thence North 79 degrees 35 minutes East 150.70 feet; thence South 15
degrees 22 minutes East parallel with the Easterly line of Depot Grounds,
25 feet; thence South 12 degrees 38 minutes East 75.29 feet; Thence
Westerly 149.36 feet to a point on the Easterly line of said Depot
grounds 84.81 feet Southerly from the place of beginning, and
thence Northerly along said Easterly-line-of Depot•groungs to the
place of beginning, in Lake County, Illinois.

and over that part of Lot 5 in Phileman Cadwell's Addition to the Town
of Deerfield aforesaid and of the North East quarter of the North East
quarter of Section 32, Township 43 North, Range 12 East of the Third
Principal Meridian, in Lake County, Illinois, bounded by a line
described as follows, to wit: Beginning at the North East corner of
Parcel 1 above described; thence South 15 decrees 22 minutes East along
the Easterly line of said Parcel 1, 25 feet; thence South 12 degrees
38 minutes East 308.6 feet to a point on the North line of Osterman
Avenue 140 feet East of said Easterly line of Depot Grounds; thence
East along the North line of Osterman Avenue 51.8 feet; thence North
12•degrees 38 minutes West 321.9 feet; thence North 15 degrees 22 minutes
West 25 feet to a point North 79 degrees 35 minutes East of the place
of beginning, and thence South 79 degrees 35 minutes West 50.2 feet to
the place of beginning, as granted by Deed from Frank M. O'Connor and
Marie F. O'Connor, his wife, to the H.D. Electric Company, a corporation
of Illinois dated March 28, 1949 and recorded March 30, 1949, as Document
666843, in Lake County, Illinois.
