ORDINANCE NO. 0- 82 -28.
AN ORDINANCE TO ABANDON FURTHER PROCEEDINGS
IN DEERFIELD SPECIAL ASSESSMENT NO. 115
REGARDING THE IMPROVEMENT OF ELM STREET
WHEREAS, in the year 1979 this Village did commence a local
improvement'in 'the'Circuit Court'of the'Nineteenth Judicial Circuit
in Lake County, Illinois regarding the improvement of Elm Street;
said proceeding being designated as Special Assessment No. 115,
Docket No. 79- TX -10; and
WHEREAS, said local improvement was to be partially paid for
out of Federal grant funds applied for by the Village, known as
Safer Off System funds administered by the Federal Highway
Administration, with the balance of the local improvement to
be paid for by special assessment against the properties so
benefited; and
WHEREAS, following the filing of the necessary petition and
the assessment report and roll, and following confirmation of the
assessment of a portion of the cost of such road improvement against
the properties benefiting therefrom, the Village was unable to
obtain the said Federal grant funds necessary in order to under-
take and pay for the construction of the local improvement to Elm
Street; and
WHEREAS, there are presently no other immediate funds available
to the Village to replace the Federal grant funds to be used for
the payment of construction of the said local improvement.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION This Board does hereby elect to abandon Special

SECTION_ The Village attorney is hereby authorized and directed
TWO: to file a certified copy of this Ordinance with the
Clerk of the Nineteenth Judicial Circuit, Lake County,
Illinois, and to forward an additional copy thereof to the Chicago
Title Insurance Company, and such other title insurance companies
as may request the same.
SECTION This Ordinance shall be in full force and effect upon
