O-82-32ORDINANCE NO. 0 -82 -32 ORDINANCE APPROVING A TAX INCREMENT REDEVELOPMENT PLAN AND REDEVELOPMENT PROJECT IN THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, the Village of Deerfield, Illinois desires to implement tax increment financing pursuant to the Real Property Tax Increment Allocation Redevelopment Act, as amended, constitu- ting Division 74.4 of Article 11 of the Illinois Municipal Code (hereinafter referred to as the "Act ") for the proposed Redevelop- ment Plan and Redevelopment Project within the municipal boundaries of the Village and within the proposed Redevelopment Project Area described in Section 1(a) of this ordinance. WHEREAS, the administrative staff of the Village has prepared a report entitled: "Tax Increment Financing District Village of Deerfield, Illinois, March, 1982" which constitutes the Redevelopment Plan required by the Act. WHEREAS, pursuant to Section 11- 74.4 -5 of the Act, the Village caused a public hearing to be held and completed relative to the Redevelopment Plan and Redevelopment Project and the designation of a Redevelopment Project Area at a meeting of the Board of Trustees held on March 18, 1982 in the Board Room of the Village Hall. WHEREAS, due notice in respect to such hearing was given pursuant to Section 11- 74.4 -5 and 6 of the Act. WHEREAS, the Redevelopment Plan and Project set forth the factors constituting blight in the proposed Redevelopment 1. Project Area, and the Board of Trustees has reviewed testimony concerning blight presented at the public hearing and has reviewed other studies and is generally informed of the conditions of blight in the proposed Redevelopment Project Area as said term "blight" is used in the Act. WHEREAS, the Board of Trustees has reviewed the condi- tions pertaining to lack of private investment in the proposed Redevelopment Project Area to determine whether private development would take place in the proposed Redevelopment Project Area as a whole without the adoption of the proposed Redevelopment Plan. WHEREAS, the Board of Trustees has reviewed the condi- tions pertaining to real property in the proposed Redevelopment Project Area to determine whether contiguous parcels of real property and improvements thereon in the proposed Redevelopment Project Area would be substantially benefited by the proposed Redevelopment Project improvements. WHEREAS, the Board of Trustees has reviewed its proposed Redevelopment Plan and Project and the Comprehensive Plan for development of the Village as a whole to determine whether the proposed Redevelopment Plan and Project conform to the Comprehen- sive Plan of the Village; NOW, THEREFORE,.BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, ILLINOIS, AS FOLLOWS: Section 1. The Board of Trustees of the Village hereby makes the following findings: -2- (a.) The area constituting the proposed Redevelopment Project Area is described as follows.: Starting at the Southeast Corner of the Southwest Quarter of Section 33; thence Northerly fifty feet; thence westerly 991.82 feet to the point of beginning; thence southeast - wardly along the westernmost right -of -way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad 1470 feet; thence westerly 106 feet to the Northernmost right -of -way line of the Edens Spur; thence westerly along said right -of -way line 2183 feet; thence Northerly along the easternmost tollway right -of -way .line of Pfingsten Road 1062 feet, approximately, to the centerline of Lake -Cook Road; thence westerly 1298 feet along the centerline of Lake -Cook Road; thence Southerly 1073 feet along the western property line of the Northbrook Gun Cl-.1b to the Northern right -of -way line of the Edens Spur; thence Westerly 2786.35 feet to.the Westerly right -of- way line of Huehl Road; thence Northerly along said right - of -way line 403 feet to the Southeast corner of the property commonly known as the "Strub Farm"; thence Westerly 1653.77 feet to the Southwest corner of said "Strub Farm', thence Northerly along the property line of "Strub Farm" 731.74 feet to the centerline of Lake -Cook Road; thence East along said centerline 4432.44 feet; thence Northerly 1387.38 feet to the centerline of the West Fork of the North Branch of the Chicago River; thence Northerly along said centerline. 1589.41 feet to the northern right -of -way line of Hackberry; thence east along said right -of -way line 1090 feet to the Southeast corner of Shepard School, commonly known as 440 Grove Avenue; thence South 40 feet to the centerline of Hackberry; thence Easterly 793.9 feet to a point 393.10 feet West of the Westerly right -of -way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence North 611.2 feet; thence :East 104 feet to the Westerly right -of -way line of the Chicago, Milwaukee; St. Paul and Pacific Railroad; thence Southerly along said right -of -way line 1352.85 feet; thence East to and along the Northern right -of -way line of Kates Road 1600.37 feet to the centerline of Waukegan Road; thence southerly along said centerline 2172.65 feet; thence West 78.7 feet to a point intersecting the Northernmost right -of -way line of Lake -Cook Road; thence westerly along said right -of -way line 1635.37 feet to the point of beginning; all located in Sections 4, 5, 6, 32 and 33, Townships 42 and 43 North, Range 12, East of the Third Principal Meridian, in Lake and Cook Counties, Illinois. -3- (b.) There exist conditions which cause the area proposed to be designated as a Redevelopment Project Area to be classified as a "Blighted Area" as defined in Section 11 -74.4- 3(a) of the Act. (c.) The proposed Redevelopment Project Area on the whole has not been subject to growth and development through investment by private enterprise and would not be reasonably anticipated to be developed without the adoption of the Redevelop- ment Plan. (d.) The Redevelopment Plan and Redevelopment Project conform to the Comprehensive Plan for the development of the Village as a whole. (e.) The parcels of real property in the proposed Redevelopment Project Area are contiguous and only those contiguous parcels of real property and improvements thereon which will be substantially benefited by the proposed redevelopment project improvement are included in the proposed Redevelopment Project Area. (f.) The estimated date for final completion of the Redevelopment Project is November 1, 2004. (g.) The estimated date for retirement of obligations incurred to finance Redevelopment Project Costs is not later than November 1, 2004. Section 2. The Redevelopment Plan and Redevelopment Project presented at this meeting and on file in the office of the Village Clerk are each hereby adopted and approved. Section 3. This ordinance shall become effective in the manner provided by law. Clampitt, Village Clerk of the Village of Deerfield, Illinois, hereby certify that the foregoing ordinance entitled: "Ordinance Approving a Tax Increment Redevelopment Plan and Redevelopment Project in the Village of Deerfield, Illinois," is a true copy of an original ordinance which was duly adopted by the recorded affirmative votes of a majority of the members of the Board of Trustees of the Village at a meeting thereof which was duly called and held at 8:00 p.m.'on June 7, 1982 in the Board Room at the Village Hall, and at which a quorum was present and acting throughout, and that said copy has been compared by me with the original ordinance signed by.the Village President, and recorded in the Ordinance Book of the Village and that it is a correct transcript thereof and of the whole of said ordinance, and.that said ordinance has not been altered, amended, repealed or revoked, but is in full force and effect.
