O-82-33I ORDINANCE NO. .-Q,-82-33 ORDINANCE DESIGNATING A REDEVELOPMENT PROJECT AREA AND ADOPTING TAX INCREMENT ALLOCATION FINANCING IN THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, the Village of Deerfield, Illinois desires to implement tax increment financing pursuant to the Real Property Tax Increment Allocation Redevelopment Act, as amended, constitut- ing Division 74.4 of Article 11 of the Illinois Municipal Code (hereinafter referred to as the "Act ") for the Redevelopment Plan and Redevelopment Project approved and adopted pursuant to an ordinance adopted by the President and Board of Trustees of the Village on June 7, 1982 and entitled: "Ordinance Approving a Tax Increment Redevelopment Plan and Redevelopment Project in the Village of Deerfield, Illinois" (the "Redevelopment Ordinance "). WHEREAS, it is now necessary to designate the area referred to in said plan as a Redevelopment Project Area as pro- vided in the Act and to authorize tax increment allocation financ- ing with respect to such Redevelopment Project Area. WHEREAS, the area described in Section 1 of this ordi- nance constitutes, in the aggregate, more than 1 -1/2 acres and has been determined to be a "Blighted Area" within the meaning of Section 11- 74.4 -3(a) of the Act. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, ILLINOIS, AS FOLLOWS: Section 1. The following described area is hereby designated as a.Redevelopment Project Area pursuant to Section 11- 74.4 -4 of the Act: Starting at the Southeast Corner of the.Southwest Quarter of Section 33; thence Northerly fifty feet; thence westerly 991.82 feet to the point of beginning; thence southeast - wardly along the westernmost right -of -way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad 1470 feet; thence westerly 106 feet to the Northernmost right -of -way line of the Edens Spur; thence westerly along said right -of -way line 2183 feet; thence Northerly along the easternmost tollway right -of -way line'of Pfingsten Road 1062 feet, approximately, to the centerline of Lake -Cook Road; thence westerly 1298 feet along the centerline of Lake -Cook Road; thence Southerly 1073 feet along the western property line of the Northbrook Gun Club to the Northern right -of -way line of the Edens Spur; thence Westerly 2786.35 feet to the Westerly right -of- way line of Huehl Road; thence Northerly along said right - of -way line 403 feet to the Southeast corner of the property commonly known as the "Strub Farm "; thence Westerly 1653.77 feet to the Southwest corner of said "Strub Farm ", thence Northerly along the property line. of "Strub Farm" 731.74 feet to the centerline of Lake -Cook Road; thence East along said centerline 4432.44 feet; thence Northerly 1387.38 feet to the centerline of the West Fork of the North Branch of the.Chicago River; thence Northerly along said centerline 1589.41 feet to the northern right -of -way line of Hackberry; thence east along said right -of -way line 1090 feet to the Southeast corner of Shepard.School, commonly known as 440 Grove Avenue;_ thence South 40 feet to the centerline of Hackberry; thence Easterly 793.9 feet to a point 393.10 feet West of the Westerly right -of -way line of the Chicago, Milwaukee; St. Paul and Pacific Railroad; thence North 611.2 feet; thence East 104 feet to the Westerly right -of -way line of the Chicago, Milwaukee,' St. Paul and Pacific Railroad; thence Southerly along said right -of -way line 1352.85 feet; thence East to and along the Northern right -of -way line of Kates Road 1600.37 feet to the centerline of Waukegan Road; thence southerly along said centerline 2172.65 feet; thence West 78.7 feet to a point intersecting the Northernmost right -of -way line of Lake -Cook Road; thence westerly along said right -of -way line 1635.37 feet to the point of beginning; all located in Sections 4, 5, 6, 32 and 33, Townships 42 and 43 North, Range 12,.East of the Third Principal Meridian, in Lake and Cook Counties, Illinois. -2- Section 2. Pursuant to Section 11- 74.4 -8 of the Act, tax increment allocation financing is hereby adopted with respect to the Redevelopment Plan and Project approved by virtue of the adoption of the Redevelopment Ordinance and with respect to the Redevelopment Project Area designated in Section 1 of this Ordi- nance. After the total equalized assessed valuation of taxable real property in the Redevelopment Project Area exceeds the total initial equalized assessed value of all taxable real property in the Redevelopment Project Area, the ad valorem taxes, if any, arising from the levies upon real property in the Redevelopment Project Area by taxing districts and the rates determined in the manner provided in Section 11- 74.4 -9(b) of the Act each year after the effective date of this Ordinance until the Redevelopment Project Costs and obligations issued in respect thereto have been paid shall be divided as follows: (a) That portion of taxes levied upon each taxable lot, block, tract or parcel of real property which is attributable to the initial equalized assessed value of each such taxable lot, block, tract or parcel of real property in the Redevelopment Project Area shall be allocated to and when collected shall be paid by the county collector to the respective affected taxing districts in the manner required by law in the absence of the adoption of tax increment allocation financing. (b) That portion, if any, of such taxes which is attributable to the increase in the current equalized assessed valuation of each lot, block, tract or parcel of real property in the Redevelopment Project Area over and above the initial equalized -3- assessed value of each property in the Redevelopment Project Area shall be allocated to and when collected shall be paid to the Village Treasurer who shall deposit said funds in a special fund called the 111982 Special Tax Allocation Fund" of the Village for the purpose of paying Redevelopment Project Costs and obligations incurred in the payment thereof, pursuant to such appropriations which may be subsequently made. Section 3. The Village Clerk is hereby authorized to file a certified copy of this ordinance with the County Clerk of Cook County and with the County Clerk of Lake County. Section 4.
