O-82-37ORDINANCE NO. 0 -82 -37 AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 250 LAKE -COOK ROAD, CADWELL'S CORNERS, DEERFIELD, ILLINOIS Published in pamphlet form this rj day of August , 1982, by the President and Board of Trustees of Deerfield. 1 I ORDINANCE NO. 0 -82 -37 AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 250 LAKE -COOK ROAD, CADWELL'S CORNERS, DEERFIELD, ILLINOIS WHEREAS, CADWELL'S CORNERS PARTNERSHIP has petitioned for a modification from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the display of 2 business wall signs on a building wall in lieu of the one permitted; addition- ally permitted is a ground sign having a gross surface area of 131 square feet in lieu of the permitted 120 square feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and the Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning Board ONE: of Appeals recommeding approval of the petition are concurred in and adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that unnecessary or TWO: undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 1 of Ace Hosts of Illinois Subdsivision of Lot 2 in John A. Mallin Subdivision of part of the southwest quarter of the southeast quarter of Section 33, Township 43 North, Range 12, East of the Third Principal Meridian in Lake County, Illinois (said Lot 1 consisting of approximately 3.02 acres). and Lot 3 of John A. Mallin Subdivision 0 Part of the southwest quarter of the southeast quarter of Section 33, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois (said Lot 3 consisting of approximatey 5.12 acres). � w SECTION That a modification from the strict provisions of Article.9 THREE: of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of 2 busi- ness wall signs on a building wall in lieu of the one permitted sign, and a ground sign having a gross surface area of 131 square feet in lieu of:the permitted 120 square feet, all in accordance with the plans presented and filed with the Zoning Board of Appeals, and subject to the further conditions that said modi- fication shall apply only to the Petitioner's signs and not to any successor, assign or future occupant of the above - described property. SECTION That the variation hereby granted is subject to compliance FOUR: by the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage and approval, as provided by law.
