O-82-38ORDINANCE NO. 0 -82 -38 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1265 OXFORD ROAD, DEERFIELD, ILLINOIS WHEREAS, MR. AND MRS. HENRY F. JOHNSON have petitioned for a variation from the strict provisions of Articles 4.3- 6(3)(B) of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the construction of a room addition 6 feet from an interior side yard which does not meet the required 8 foot minimum side yard and a total side yard of 16 feet in lieu of the required 20 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning Board ONE: of Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hardships in TWO: the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners' property, which is legally described as follows: Lot 22 in Block 9 in H.M. Cornell Co.'s Briarwoods, a Resubdivision of Blocks 4, 6, 7, 8, 9, 11, 12, Lots 1 to 24, inclusive, in Block 20, Blocks 21, 22, 23, 25, 26, 27, 28, and 29 in H.O. Stone & Co.'s' Addition to Deerfield, in Sections 28 and 29, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois. SECTION That a variation from the strict provisions of Articles 4.3 -6(3) THREE: (B) of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property herein - above described, is hereby granted so as to permit the construction of a room addition 6 feet from an interior side yard which does not meet the required 8 foot minimum side yard and a total side yard of 16 feet in lieu of the required 20 feet; all in accordance with the plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by the FOUR: Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage and approval, as provided by law.
