ORDINANCE NO. 0 -82-40
AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN
PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE
PROPERTY COMMONLY KNOWN AS 725 LAKE -COOK ROAD, DEERFIELD, ILLINOIS
WHEREAS, the Burton T. Getz Company has petitioned for a modification from
the strict provisions of Article 9 of the Zoning Ordinance of the Village of
Deerfield, passed April 17, 1978, as amended, to permit the display of a
double -faced non - illuminated ground real estate sign having a surface area of
128 square feet per face in lieu of the permitted 20 square feet per face; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and the
Board of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning Board
ONE: of Appeals recommending approval of the petition are concurred
in and adopted by the President and Board of Trustees.
SECTION That the President and Board of Trustees find that unnecessary or
TWO: undesirable circumstances would result from carrying out the
strict letter of the provisions of the Zoning Ordinance of the
Village of Deerfield as applied to Petitioner's property, which is legally
described on Exhibit A attached hereto and made a part hereof.
SECTION That a modification from the strict provisions of Article 9 of
THREE: the Zoning Ordinance of the Village of Deerfield, passed April
17, 1978, as amended, with respect to the property hereinabove
described is hereby granted so as to permit the display of a double -faced non-
illuminated ground real estate sign having a surface area of 128 square feet
per face to be located on the south side of the subject property facing the
Tollway spur and to be permitted for a period not to exceed 24 months.
SECTION That the modification hereby granted is subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the Zoning
Ordinance and with all other applicable ordinances of the Village
of Deerfield.
SECTION That this Ordinance shall be in full force and effect from and
FIVE: after its passage and approval, as provided by law.
