O-82-02ORDINANCE NO.,,0- 82 -02_ AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 707 LAKE -COOK ROAD, DEERFIELD, ILLINOIS WHEREAS, FLODSTROM CONSTRUCTION COMPANY has petitioned for a modification from the strict provisions of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the display of signs at a height of 45 feet above the curb in lieu of the required 30 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and the Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning Board ONE: of Appeals recommending approval of the petition are concurred in and adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees find that unnecessary or TWO: undesirable circumstances would result from carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of.Deerfield as applied to Petitioner's property, which is legally described as follows: Parcel 1 That part of the Northwest Quarter of Section 4, Town- ship 42 North, Range 12, East of the Third Principal Meridian, described as follows: Beginning at a point on the North line of said Section 4, 479.37 feet East of the Northwest corner of said Section .4, thence East along the North line of said Section 4, 422.65 feet to a point; thence South along a line at an angle with the North line of said Section 4 of 90 degrees - 10' - 30" measured from West to South for a distance of 735.92 feet to a point on the center line of the Union Drainage District Ditch, thence Northwesterly along the center line of said Ditch 562.19 feet to a point; thence North 367.79 feet along a line which is perpendicular to the North line of said Section 4 to a point of beginning (except the North 50 feet thereof) all in Northfield Township, Cook County, Illinois. . "4- Included: Parcel 2 Beginning at a point on the North line of said Section 4, 909.02 feet East of the North West corner of said Section 4, thence Southerly at angle with the North line of said Section 4, of 90 degree 10' 30" (measured from West to South) a distance of 735.92 feet and to the center line of the Union Drainage District Ditch; thence Southeasterly along the center line of said ditch 72.77 feet to a line 55.0 feet (right angles MS) East of a parallel with previously described 735.92 feet line; thence North 783.40 feet to a point on the North line of the Section 4, 55.0 feet East of the point of beginning; thence West along said North line a distance of 55.0 feet to the point of beginning, (except the North 50.0 feet thereof) all in Cook County, Illinois. SECTION That a modification from the strict provisions of Article 9 of THREE: the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the property hereinabove described is hereby granted so as to permit the display of signs at a height of 45 feet above the curb in lieu of the required 30 feet, all in accordance with the plans presented and filed with the Zoning Board of Appeals, and subject to the further conditions that said signs not be illuminated and that said modification shall apply only to the Petitioner's signs and not to any successor, assign or future occupant of the above - described property. SECTION That the variation hereby granted is subject to compliance by the FOUR: Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage and approval, as provided by law.
