AN ORDINANCE GRANTING A MODIFICATION FROM THE SIGN PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN
AS LAKE -COOK OFFICE CENTER 1415 LAKE -COOK ROAD, DEERFIELD, ILLINOIS
WHEREAS, the American National Bank and Trust Company as Trustee under
Trust No. 51702 has petitioned for a modification from the strict provisions
of Article 9 of the Zoning Ordinance of the Village of Deerfield, passed April
17, 1978, as amended, to permit the display of three double -faced illuminated
real estate signs in lieu of the one permitted at a height of 18 feet above
the curb in lieu of the permitted 10 feet and having a surface area of 200
square feet per face in lieu of the permitted 20 square feet; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and the
Board of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning Board
ONE: of Appeals recommending approval of portions of the petition and
recommending denial of portions of the petition are modified and
adopted as so modified by the President and Board.of Trustees.
SECTION That the President and Board of Trustees find that unnecessary or
TWO: undesirable circumstances would result from carrying out the
strict letter of the provisions of the Zoning Ordinance of the
Village of Deerfield as applied to Petitioner's property, which is legally
described on Exhibit A attached hereto and made a part hereof.
SECTION That a modification from the strict provisions of Article 9 of.
THREE: the Zoning Ordinance of the Village of Deerfield, passed April
179 1978, as amended, with respect to the property hereinabove
described is hereby granted so as to permit the display of the following signs:
(a) An illuminated double -faced sign up to 200 square
feet in size per face to be located on the south
side of the subject property facing the Tollway
Spur and to be constructed in a "V" shaped con-
figuration and with its base at a height not to
exceed three feet above grade and its maximum
height not to exceed 13 feet above grade and to
be permitted for a period not to exceed 36
months; and
(b) An illuminated double -faced sign up to 200 square
feet in size per face to be located at approxi-
mately the mid -point of the subject property's
Lake -Cook Road frontage and to be constructed in
a "V" shaped configuration with a 30 degree maxi-
mum angle in the "V" and with its base at a height
not to exceed three feet above grade and its
maximum height not to exceed 13 feet above grade
and to be permitted for a period not to exceed 36
months. The illumination of said sign is per-
mitted only between the hours of 6 A.M. and 7 P.M.
SECTION That the modification hereby - granted is subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the Zoning
Ordinance and with all other applicable ordinances of the Village
of Deerfield.
SECTION That this Ordinance shall be in full force and effect from and
FIVE: after its passage and approval, as provided by law.
