O-81-754� ORDINANCE NO. 0 -81 -75 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1041 HAZEL AVENUE, DEERFIELD ILLINOIS WHEREAS, MR. JAMES C. MITCHELL, JR. has petitioned for a variation from the strict provisions of Article 10.1 -1 of the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to permit the construction of a room addition to an existing non - conforming building while not altering the existing 2.04 foot minimum single side yard which does not meet the required 8 foot minimum; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, The. Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES-OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS.FOLLOWS: SECTION That the findings of fact and recommendation of the Zoning Board ONE: of Appeals are concurred in and adopted as the findings of fact of the Pre "sident and Board of Trustees. SECTION That there are practical difficulties and particular.. hardships TWO: in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 4, 5, and 6 in Block 14 in "DEERFIELD PARK LAND AND IMPROVEMENT ASSOCIATION SUBDIVISION ", being a sub- division of part of the Southeast quarter of Section 29, Township 43 North, Range 12, East of the Third Principal Meridian; according to the plat thereof Recorded May 5, 1898 as Document No. 70892, in Book "D" of plats, page 64 therein, in Lake County, Illinois. SECTION That a variation from the strict provisions of Article 10.1 -1 of THREE: the Zoning Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, with respect to the-property hereinabove described, is hereby granted -,?so as to permit the construction of a room addi- tion to an existing non - conforming building while not altering the existing 2.04 foot minimum single side yard which does not meet the required 8 foot minimum, all in accordance with the plans presented and filed with the Zoning Board of Appeals. '% e I SECTION That the variation hereby granted is subject to compliance by the FOUR: Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage and approval, as provided by law.
