ORDINANCE NO. 0 -81 -25
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1234 CARLISLE, DEERFIELD, ILLINOIS
WHEREAS, MR. AND MRS.. ELLIOTT C. SHEAR have petitioned for a variation
from the strict provisions of Article 10.1 -1 of the Zoning Ordinance of the
Village of Deerfield, .passed April 17, 1978, as amended, to permit the con-
struction of a room addition to an existing non - conforming building while not
altering the existing 25 foot front yard which does not meet the required 30
foot minimum established by the recorded building line; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and Board
of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND- BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning Board
ONE: of Appeals are concurred in and adopted as the findings of fact
of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships in
TWO: the way of carrying out the strict letter of the provisions of
the Zoning Ordinance of the Village of Deerfield as applied to
Petitioners' property, which is legally described as follows:.
Lot 12 in Block 9 of H.M. Cornell Company's Briarwood,
a resubdivision of parts of the J.C. Stone and Company's
addition to Deerfield in Section 28 and 29 Township 43
North, Range 12, East of the Third Principal Meridian
according to the plat of said resubdivision recorded
November 27, 1928 as Document 328430 in Book T of
Plats, pages 40 and 41, in Lake County, Illinois, and
commonly known as 1234 Carlisle.
SECTION That a variation frcm the strict provisions of Article 10.1 -1 of
THREE: the Zoning Ordinance of the Village of Deerfield, passed April
17, 1978, as amended, with respect to the property hereinabove
described, is hereby granted so as to permit the 'construction of a room
addition to an existing non - conforming building while not altering the existing
25 foot front yard which does not meet the required 30 foot minimum established
by the recorded building line, all in accordance with the plans presented and
filed with the Zoning Board of Appeals. ,
SECTION That the variation hereby granted is subject to compliance by
FOUR: the Petitioners with all other applicable provisions of the
Zoning Ordinance and with all other applicable ordinances of the
Village of Deerfield.
SECTION That this Ordinance shall be in full force and effect from and
FIVE: after its passage and approval, as provided by law.
