ORDINANCE NO. 0- 81 -28. AN ORDINANCE AUTHORIZING A SPECIAL USE - COMMERCIAL PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of MILDRED M. FRITZ and RALPH MALLIN, as co- executors of the Estate of John A. Mallin, Deceased, AMERICAN NATIONAL BANK AND TRUST COMPANY, as Trustee under Trust Number 48023, CADWELL'S CORNERS PARTNERSHIP, JAMES DiPIETRO and SALVATORE C. BUCCOLA (herein collectively referred to as "Applicant ") to authorize the development and use of certain real estate described on Exhibit A hereto for a Special Use - Commercial Planned Unit Development under and pursuant to the provisions of Articles 5.2 -3, 8; 12.1 -2; 12.4 and 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, following consideration of the recommendations of the Plan Commission, and the Preliminary Development Plan by the President and Board of Trustees, and Applicant's subsequent revision thereof, the President and Board of Trustees have considered and reviewed the Final Development Plan by Appli- cant reflecting all revisions from the original Preliminary Development Plan; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use - Commercial Planned Unit Develop- ment in accordance with a certain Plan of Development marked Exhibit B and attached hereto and made a part hereof, and that certain exceptions and varia- tions from the otherwise applicable regulations of this Ordinance as reflected on said Exhibit B are warranted. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively ONE: find that the Special Use, as hereby authorized, fully complies with the requirements and standards set forth in Articles 1.2.4 and 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Commercial Planned Unit Development as set forth on Exhibit B, be and the same is hereby authorized and approved subject to the conditions hereinafter set forth. SECTION That the approval and authorization of said Special Use hereby TWO: granted is subject to the following conditions: (A) That all use, construction and development shall be in accordance with a certain Site Plan dated :Marc_h` 0 , 1981 prepared by Bonesz, Mass, Buccola, Architects, a copy of which is marked Exhibit B and attached hereto and made a part hereof, all other documentary and exhibit filings made pursuant to Planned Unit Development Procedures as set forth in Article 12.6 of the Village Zoning Ordinance, the terms of this Ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees, specifically including but not lmited to the following: 1. Face brick will be used for all construction throughout the development. 2. Applicant consents to any future restrictions on turn- ing movements at the Lake -Cook Road exit as may be imposed from time to time by the Corporate Authorities. 3. Applicant will plant and maintain all landscaping as depicted on the Applicant's landscaping plan dated March 30 , 1981. 4. No restaurant use will be permitted on the subject real estate. 5. Applicant will, at its sole expense, maintain, repair and replace as required all utilities located on the subject real estate. 6. Applicant shall be permitted to use the curb as a wheel stop in the perimeter parking areas. (B) Applicant or their successors, grantees, transferees or assigns shall, upon demand of the Village of Deerfield, pay a sum equal to 50% of the total cost of traffic signalization and related intersection improvement upon the installation of a traffic signal at the exit from the Commercial Planned Unit Development onto Waukegan Road. SECTION That any violation of any of the conditions hereinabove set forth THREE: shall authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this FOUR: Ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION That this Ordinance shall be in full force and effect from and FIVE: after its passage, approval and publication, as provided by law. AYES: .
