AN ORDINANCE AMENDING ARTICLE 15 OF CHAPTER 22 OF
THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975•
WHEREAS, the Village of Deerfield is a Home Rule Municipality pursuant to
the provisions of Article VII of the Illinois Constitution of 1970 and, as
such, has the power to regulate for the protection of the public health, safety
and welfare of the Village; and
WHEREAS, the Village is also specifically authorized under the applicable
provisions of the Illinois Vehicle Code to regulate the operation of bicycles.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Chapter 22, Article 15 of the Municipal Code of the Village
ONE: of .Deerfield of 1975, as amended, is hereby further amended by
adding the following phrase at the end of the first paragraph of
Section 22 -128 entitled "Enforcement ":
", except to the extent otherwise provided by Section
22 -129, et sec.. of this Article 15."
SECTION That Chapter 22, Article 15 of the Municipal Code of the Village
TWO: of Deerfield of 1975, as amended, is further amended by the
addition of the following sections:
Sec. 22 -129. Deerfield Bicycle Safety Hearing Board.
There is hereby established the Deerfield Bicycle
Safety Hearing Board, the members of which shall
consist of one or more compliance officers appointed
by the President and with the advice and consent of
the Board of Trustees, following recommendation by the
Chief of Police. Said officer(s) shall serve at the
convenience of the President and the Board of Trustees
and shall have no fixed term of office.
Sec. 22 -130. Duties of Deerfield Bicycle Safety
Hearing Board.
(a) The Deerfield Bicycle Safety Hearing Board shall
have the following duties:
(1) To conduct hearings from time to time with
respect to all Notices to Appear issued by
Bicycle Safety Officers pursuant to this
Article 15, during the months of June, July
and August.
(2) To establish and adopt rules of procedure
governing said hearings.
(3) To make determinations following said
hearings as to violations of Chapter 22,
Article 15 of the Municipal Code and to
impose penalties including, but not limited
to, reprimands, participation in community
service activities and /or safety seminars,
preparation of essays and to levy fines not
to exceed $5.00 per violation.
Sec. 29 -131 Bicycle regulation enforcement.
The Chief of Police may appoint up to five (5) Bicycle
Safety Officers, at a salary not to exceed $5.00 per
hour.
Sec. 22 -132. Duties of Bicycle Safety Officers.
Bicycle Safety Officers appointed by the Chief of
Police shall have the authority to enforce the bicycle
safety and operation regulations of Chapter 22, Article
15 of the Municipal Code of the Village of Deerfield
of 1975, as amended, with respect to all bicycle oper-
ators 16 years of age or younger.
Sec. 22 -133. Notice to Appear.
Bicycle Safety Officers shall have the authority to
issue a Notice to Appear to any person 16 years of age
or younger operating a bicycle in the Village of
Deerfield in violation of the provisions of Chapter
22, Article 15 of the Municipal 'Code. All Notices to
Appear issued by Bicycle Safety Officers shall be
returnable before the Bicycle Safety Hearing Board,
and may require the attendance before 'said Board of a
parent or legal guardian of the person receiving the
Notice to Appear.
Sec. 22 -134. Issuance of summons.
Anything to the contrary herein notwithstanding, cita-
tions and summonses returnable before the appropriate
branch of the Circuit Court of Lake County may be
issued or sought by members of the Village of Deerfield
Police Department, or other persons, including Bicycle
Safety Officers, in accordance with the applicable
provisions of the Illinois Criminal Code of 1961 upon
violation of the bicycle safety and operation regula-
tions of Chapter 22, Article 15 of the Municipal Code."
SECTION That the Village Clerk is hereby directed to publish this
THREE: Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and effect from and
FOUR: after its passage and approval and publication, as provided by
law.
SECTION That all other ordinances or parts of ordinances in conflict with
FIVE: this Ordinance are hereby repealed.
