O-81-40I� ORDINANCE NO. 0 -81 -40 AN ORDINANCE AMENDING ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 1st day of June , 1981, by the President and Board of Trustees of Deerfield. r ORDINANCE NO. 0-81-40 AN ORDINANCE AMENDING ARTICLE 9 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Corporate Authorities of the Village of Deerfield to consider certain text amendments to the Zoning Ordinance relative to the adoption of regulations applicable to overhead banners not otherwise permitted by Article 9.3 -6 of the Zoning Ordinance; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after consider- ing the evidence adduced, made written findings of fact approving the text amendment to the Zoning Ordinance of the Village of Deerfield to achieve the objectives sought by the Corporate Authorities of the Village of Deerfield; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the recommendation of the Plan Commission will serve the best interests of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article 9 of the Zoning Ordinance of the Village of Deer - ONE: field, as amended, be and the same is further amended by adding to said Article the following: "9.3 -8 Overhead Banners; giving notice of events sponsored by groups or organizations which do not meet the eligi- bility criteria of Article 9.3 -6 may be erected and maintained in accordance with the following provisions: 1. Permit Required No person shall erect an overhead banner without first obtaining authorization from the Board of Trustees to request a permit. The applicant shall provide the Board of Trustees with a complete description of the size, location, and content of the proposed banner. Once authorization to request a permit has been granted by the Board of Trustees, said permit must be obtained from the Director of Building and Zoning. The permit shall not be issued unless all provisions of Article 9.3 -8 are met, except to the extent modified by the Board of Trustees. 1 , . 2. Location and Number Overhead banners may only be located at the intersection of Waukegan Road and Deerfield Road. 3. Timing Overhead banners shall not be erected or main- tained more than two weeks (14 days) prior to the date on which the event or activity advertised is to occur and shall be removed within seventy -two (72) hours after the termination of the event or activity. 4. Deposit, Insurance and Indemnification In addition to the normal sign permit fee, the permittee shall deposit with the Director of Building and Zoning the sum of two hundred ($200.00) dollars to secure the permittee's compliance with this Article, the permit, and /or the indemnification agreement described below. Prior to issuance of the Permit, the permittee shall furnish evidence of insurance naming the Village of Deerfield as loss payee or additional insured with respect to any and all liability arising as a result of permitting installation of said overhead banner in an amount satisfactory to the Director of Building and Zoning for the dura- tion of the permit period. The permittee shall also execute a signed agreement to be provided by the Village which indemnifies the Village against all loss, cost, damage, or expense incurred or sustained by or recovered against the Village by reason of the erection, maintenance, or removal of the overhead banner. The balance of the depo- sit, if any, will be returned to the permittee and any such sums payable in excess of the deposit shall be paid forthwith by the permittee. 5. Materials and Methods a. Any overhead banner which is permitted to extend over a public street shall be erected or installed in such a manner and at such a time so as to not interfere or obstruct traffic signs and signals. b. Height The applicable height restrictions contained in the Municipal Code of the Village of Deerfield shall govern for any overhead banner which is permitted to extend over a public street. 7. Area The maximum area per sign shall be determined by the Board of Trustees at the time the authoriza- tion to request a permit is granted. SECTION That the Village Clerk is hereby directed to publish this TWO: Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict herewith THREE: are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and effect from and FOUR: after its passage, approval and publication, as provided by law.
