AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 701 DEERFIELD ROAD, DEERFIELD, ILLINOIS
WHEREAS, FIRST NATIONAL BANK OF LAKE FOREST, as Trustee under Trust No.
974 has petitioned for variations from the strict provisions of Articles
8.2 -1b, 8.2 -3,5a, 8.2 -3,5b, 8.2 -3,8d, 8.2 -3,9 and 8.3 -8,2a of the Zoning
Ordinance of the Village of Deerfield, passed April 17, 1978, as amended, to
permit parking within the five foot required set -back, elimination of wheel
stops except on the eastern perimeter of the Petitioner's property, elimination
of curbing or retaining walls, elimination of double line delineation of park-
ing spaces and application of roping requirements, omission of a loading berth
and the expansion of parking spaces marked as spaces 1, 2 and 3 on Petitioner's
site plan to 12 feet 6 inches in width, with space no. 1 being reserved for
loading and unloading and space nos. 2 and 3 being handicapped parking, and 71
parking spaces total in lieu of the required 72 parking spaces; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board of
Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendations.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning Board
ONE: of Appeals are concurred in and adopted, as modified and amended
hereby, as the findings of fact of the President and Board of
Trustees
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the provisions
of the Zoning Ordinance of the Village of Deerfield as applied
to Petitioner's property, which is legally described on Exhibit A attached
hereto and made a part hereof.
SECTION That a variation from the strict provisions of Articles 8.2 -1b,
THREE: 8.2 -3,5a, 8.2 -3,5b, 8.2 -3,8d, 8.2 -3,9 and 8.3 -8,2a of the Zoning
Ordinance of the Village of Deerfield, passed April 17, 1978, as
amended, with respect to the property described on Exhibit A, attached hereto
and made a part hereof, is granted so as to permit parking within the five
foot required set -back, elimination of wheel stops except on the eastern peri-
miter of the Petitioner's property, elimination of curbing or retaining walls,
elimination of double line delineation of parking spaces and application of
roping requirements, omission of a loading berth and the expansion of parking
spaces marked as spaces 1, 2 and 3 on Petitioner's site plan to 12 feet 6
inches in width, with space no. 1 being reserved for loading and unloading and
space nos. 2 and 3 being handicapped parking, and 71 parking spaces in total
in lieu of the required 72 parking spaces, all in accordance with the plans
presented and filed with the Zoning Board of Appeals.
SECTION That the variations hereby granted are subject to compliance by
FOUR: the Petitioner with all other applicable provisions of the Zoning
Ordinance and with all other applicable ordinances of the Village
of Deerfield.
SECTION .That this Ordinance shall be in full force and effect from and
FIVE: after its passage and approval as provided by law.
