O-80-34iJ ORDINANCE NO. 0 -80 -34 AN ORDINANCE VACATING A CERTAIN STREET IN THE VILLAGE OF DEERFIELD WHEREAS, the Village of Deerfield is a Home Rule municipality exercising Home Rule powers as provided in the Constitution of the State of Illinois of 1970; and WHEREAS, the President and Board of Trustees of the Village of Deerfield after due investigation and consideration have determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of the street hereinafter described; and WHEREAS, the Village of Deerfield holds title to the property directly to the west of the street to be .vacated hereby and the United States Postal Service owns title to the property lying to the east of the street to be vacated hereby; and WHEREAS, duly authorized representatives of the United States Postal Service as owner of property lying to the east of the street to be vacated hereby have advised the Village of Deerfield in writing that said United States Postal Service does not wish to acquire any portion of the street to be vacated hereby and said United States Postal Service has expressly declined to furnish the compensation upon vacation to the Village of Deerfield required by Section 19 -23 of the Municipal Code of the Village of Deerfield of 1975, as amended, upon such vacation; and WHEREAS, in view of delinquishment of any interest in said portion of the street to be hereinafter vacated by the United States Postal Service the Corporate Authorities of the Village of Deerfield in the exercise of its Home Rule powers has deemed that title to all portions of the street hereinafter vacated shall pass to the Village of Deerfield. SECTION That this Ordinance shall be in full force and effect from and FOUR: after its passage, approval and filing for record in the manner herein provided.
