R-78-03RESOLUTION NO. R-78-3 A RESOLUTION REGARDING PREVAILING WAGE RATES WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works," approved June 26, 1941, as amended, being Section 39s -12, Chapter 48, Illinois Revised Statutes, 1973; and WHEREAS, the aforesaid Act requires that the President and Board of Trustees of the Village of Deerfield investigate and ascertain the prevailing wage rates as defined in said Act for laborers, mechanics and other workmen in the locality of said Village employed in perform- ing construction of public works for said Village exclusive of main- tenance work: NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, ILLINOIS, as follows: SECTION To the extent and as required by AN ACT regulating ONE: wages of laborers, mechanics and other workmen em- ployed in any public works by the State, county, city of any public body or any political subdivision or by any one under contract for public works, approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of this Village is hereby ascer- tained to be the same as the prevailing rate of wages for construction in Lake County as determened by the Department of Labor of the State of Illinois as of May, 1978, a copy of that determination being attached hereto and incorporated herein by reference. The definition of any terms appearing in this R"es'olution;_which are also used in the aforesaid Act shall be the same as in said Act. SECTION Nothing herein contained shall be construed to appl�, TWO: said general prevailing rate of wages as herein as-' certained to any work or employment except public works construction of this Village to the extent required by the aforesaid Act. SECTION The Village of Deerfield Clerk shall public post or THREE: keep available for inspection by any interested party in the main office of this Village this determination of such prevailing rate of wages. SECTION The Village Clerk shall mail a copy of this determina- FOUR: tion to any employer, and to any association of em- ployers and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workmen whose wages will be affected by such rates. r SECTION The Village Clerk shall promptly file a certified FIVE: copy of this Resolution with the Secretary of State and the Department of Labor of the State of Illinois. SECTION The Village Clerk shall cause to be published in a SIX: newspaper of general circulation within the area a copy of this Resolution, and such publication shall constitute notice that the determination is effective and is the determination of this public body.
