ORDINANCE NO. 0 -80 -39
WHEREAS, the Corporate Authorities of the Village of Deerfield have
received a petition from Mrs. Lela P. Berglund ( "Petitioner ") , the owner of
real estate within the Village of Deerfield commonly described as 704 Kipling
Place, Deerfield, Illinois, seeking a variation from the strict application of
the provisions of Section 19.28(1) of the Municipal Code of 1975 of the
Village of Deerfield, as amended, enabling said Petitioner to maintain a
driveway having a width of 25 feet in lieu of the 18 foot maximum width
allowed thereby; and
WHEREAS, Petitioner has presented evidence and testimony establishing the
hardship created by strict compliance with the provisions of said Section
19.28(1) while still maintaining a separate parking area and endeavoring to
maintain existing trees on the subject property; and
WHEREAS, the Corporate Authorities of the Village of Deerfield have
considered the evidence and testimony adduced and deem it to be in the best
interests of the Village of Deerfield to permit said variation from the strict
application of Section 19.28(1) so as to permit Petitioner to maintain a
driveway 25 feet in width in lieu of the required 18 feet in width.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Petitioner be permitted to maintain a driveway having a
ONE: width of 25 feet in lieu of the 18 foot maximum established by
Section 19.28(1) of the Municipal Code of the Village of
Deerfield of 1975, as amended, on the property commonly known as
704 Kipling Place, Deerfield, Illinois.
SECTION That Petitioner be required to comply with all other applicable
TWO: laws and ordinances of the Village of Deerfield as they apply to
the subject property.
SECTION That the Ordinance shall be in full force and effect from and
THREE: after its passage, approval and publication as provided by law.
