O-79-54. f ORDINANCE NO. 0 -79- 54 AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD AND CHAPTER 20 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD WHEREAS, Chesterfield Development Corporation has made application to the Plan Commission of the Village of Deerfield for approval of a Preliminary Plat of Subdivision of certain real estate hereinafter described and has further petitioned for classification of said real estate in the "R -2 Single Family District" of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Preliminary Plat of Subdivision required consideration by the Plan Commission of certain requested variations on several of the proposed lots as to lot width, rear yard and front yard; and WHEREAS, said application, including said variations, was considered at a public meeting of the Plan Commission which was, in all respects, held accord- ing to law; and WHEREAS, the Plan Commission of Deerfield, after considering the evidence adduced, recommended that said Preliminary Plat of Subdivision be approved and that the variations requested be approved subject to certain conditions and restrictions; and WHEREAS, in the course of consideration of the recommendations, the Cor- porate Authorities have determined that certain aspects of the Preliminary Plat of Subdivision will require variations from certain requirements of Chapter 20 of the Municipal Code of the Village of Deerfield. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the proposed residential development of the real estate ONE: legally described on Exhibit "A" attached hereto and as set forth and described on the attached Preliminary Plat of Subdivision, which Preliminary Plat of Subdivision is made apart of this ordinance, be and is hereby approved, subject to the conditions and restrictions hereinafter set forth. SECTION (a) That Lots 2, 8, 9 and 20, as depicted on said Preliminary TWO: Plat of Subdivision, be permitted to have lot widths of 75 feet in lieu of the required 80 foot lot width as required by the Zoning Ordinance of the Village of Deerfield; (b) that Lot 12, as depicted on said Preliminary Plat of Subdivision, shall have a rear yard of 36 feet in lieu of the required 40 feet; (c) that Lot 1.5' as depicted on said Preliminary Plat of Subdivision, shall have a front yard of 31.5 feet in lieu of the required 35 feet; (d) that the paved portion of the dedicated right -of -way, depicted on said Preliminary Plat of Subdivision, shall have a width ranging from 20 feet to 24 feet in lieu of the 28 foot width required by Chapter 20 of the Municipal Code of the Village of Deerfield; and (e) that the installation of sidewalks as required by Chapter 20 of the Municipal Code of the Village of Deerfield be waived. � t SECTION That the approval of said Preliminary Plat of Subdivision is THREE: subject to the condition that, except as otherwise provided in this ordinance, the developer shall comply with all requirements of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield. SECTION That this ordinance shall be in full force and effect from and FOUR: after its passage and approval as provided by law.
