ORDINANCE NO. 0 -79- 56 AN ORDINANCE AMENDING ORDINANCE NO. 77 -61 AUTHORIZING A SPECIAL USE FOR A SYNAGOGUE WITH ACCESSORY USES AS A RELIGIOUS SCHOOL, DAY NURSERY AND CHILD CARE CENTER AT BRIARWOOD'ItSCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the BOARD OF EDUCATION OF SCHOOL DISTRICT 109 and the DEERFIELD PARK DISTRICT to authorize an amendment to Ordinance 77 -61 to permit an increase in the enrollment in the day nursery and child care center located at Briarwood School, Deerfield, Illinois, under and pursuant to the provisions of Article 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to a duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after consider- ing the evidence adduced, made written findings of fact and recommended that said amendment to the special use of said real estate be approved and author- ized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Commission are ONE: concurred in and adopted as the findings of the President and Board of Trustees and the amendment to the special use of the real estate legally described in the Notice of Hearing attached hereto and made a part hereof, to include a day nursery and child care center with an enrollment limit of 100 children, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said special use hereby TWO: given is subject to the requirements that all use shall be in accordance with all representations submitted and made by Appli- cants to the Plan Commission and President and Board of Trustees and is also subject to compliance by Applicants with all other applicable provisions of the Zoning Ordinance, specifically including the requirement that the enrol- lment of the day nursery and child care center be limited to a maximum of 100 children. SECTION That the approval and authorization of said special use hereby THREE: given is subject to the requirement that this ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicants. . „6 .
