I I ORDINANCE NO. 0 -79 -10 AN ORDINANCE AUTHORIZING A SPECIAL USE - PUBLIC UTILITY FACILITY WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of ILLINOIS BELL TELEPHONE COMPANY (herein referred to as "Applicant ") to authorize the expansion and continued use of certain real estate described below for a Special Use - Public Utility Facility under and pursuant to the provisions of Article 2.0 -3,2 of the Zon- ing Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held by the Plan Commission of the Village of Deerfield pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, Applicant's proposal calls for the expansion of the existing facility by the addition of a second story and Article 2.0 -3,2 requires that such an expansion be treated as an expansion of an existing Special Use; and WHEREAS, the Plan Commission of Deerfield, after considering the evidence adduced, made written findings of fact including express affirmative findings of compliance with the above cited provision of the Village of Deerfield Zon- ing Ordinance and recommended that the Special Use of said real estate as an expanded Public Utility Facility be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use in accordance with the testimony adduced at the aforementioned Plan Commission hearing. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively ONE: find that the special use, as hereby authorized, fully complies with the requirements and standards set forth in Article 13.11 -4 of the Village Zoning Ordinance, and the Special Use of the real estate, as and for purposes of a Public Utility Facility, be and the same is hereby authorized and approved for the real property legally described below, subject to the conditions hereinafter set forth: The West 150 feet of the East 210 feet of the South 233 feet of the Southeast Quarter of the Southeast Quarter of Section 29, Township 43 North, Range 12, East of the 3rd P.M. in Lake County, Illinois. SECTION That the approval and authorization of said Special Use hereby TWO: granted is subject to the following conditions: (a) That all use, construction and development shall be in accor- dance with the testimony and documentary evidence adduced at said Plan Commission hearing, the terms of this ordinance, and all representations by the Applicant to the Plan Commission and President and Board of Trustees. (b) That the use of the structure as expanded shall be for a commu- nications distribution center as presently used and, further, that any existing general office use of the premises shall not be expanded. SECTION That any violation of the conditions hereinabove set forth shall THREE: authorize the revocation of the Special Use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this FOUR: ordinance in pamphlet form and see to its recordation in the office of the Recorder of Deeds of Lake County, Illinois, at Applicant's expense. SECTION That this ordinance shall be in full force and effect from FIVE: and after its passage, approval and publication, as provided by law.
