O-79-16ORDINANCE N0. 0 -79- 16 AN ORDINANCE AMENDING ARTICLE 10 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 2nd day of April , 1979, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -79 -16 AN ORDINANCE AMENDING ARTICLE 10 OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the Village of Deerfield (herein referred to as "Applicant ") to consider a proposed amendment to Article 10.2 -1,2 of the Zoning Ordinance of the Village of Deerfield, as amended, in order to provide relief for developed lots of 75 feet or less from certain restrictive provisions applicable to non - conforming lots of record; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, recommended that the proposed amendment to Article 10.2 -1,2 be approved; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the second and third paragraphs of Article 10.2 -1,2 ONE: of the Zoning Ordinance of the Village of Deerfield, as amended, be and the same are hereby further amended by deleting them in their entirety and substituting the following in lieu thereof: "However, in the case of the side yard requirements for developed nonconforming lots of record in the R -3 zoning district, having the proscribed width or less, and where side yards are less than required, the total interior side yard required must not be less than 70 percent called for in that particular single - family zoning district and have a single interior side yard of not less than 5 feet. Undeveloped nonconforming lots of record in all zoning districts shall provide and maintain all setbacks as required for that particular zoning district. Further required is that all corner yards must be maintained according to the setbacks required for that particular zoning district. Variance from any other requirements shall be obtained only through the procedures as outlined in Article 13, Admini- stration and Enforcement." SECTION That the Village Clerk is hereby directed to publish this TWO: ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict here - THREE: with are, to the extent of such conflict, hereby repealed. SECTION That this ordinance shall be in full force and effect from FOUR: and after its passage, approval and publication, as provided by law.
