AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS
OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY
COMMONLY KNOWN AS 1035 FOREST AVENUE, DEERFIELD, ILLINOIS
WHEREAS, MR. AND MRS. JOSEPH DIBELLO have petitioned for a variation
from the strict provisions of Article 2.2 -2 of the Zoning Ordinance of the
Village of Deerfield, passed April 17, 1978, as amended, to permit two lots
having a lot area of 6,250 square feet in lieu of the required 9,000 square
feet and having a lot width of 50 feet in lieu of the required 75 feet and
to permit the existence of a non - conformity as to the existing structure on
Lots 51 and 52 in that the total side yard will be 12.57 feet in lieu of
the required 20 foot width, neither side yard meeting the required 8 foot
per side minimum; and
WHEREAS, pursuant to notice duly published, as required by statute, a
public hearing on said petition was held and conducted by the Zoning Board
of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the President and
Board of Trustees its written findings of fact and recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of the Zoning
ONE: Board of Appeals are concurred in and adopted as the find-
ings of fact of the President and Board of Trustees.
SECTION That there are practical difficulties and particular hardships
TWO: in the way of carrying out the strict letter of the
provisions of the Zoning Ordinance of the Village of Deerfield
as applied to Petitioners' property, which is legally described as follows:
Lots 51, 52, 53 and 54 in Block 6 in Deerfield Park
Land and Improvement Association, a subdivision of
part of the S.E. 1/4 of Sec. 29, Township 43 North,
Range 12, East of the Third Principal Meridian,
according to plat thereof recorded in Book "D" of
Plats, page 64, in Lake County, Illinois.
SECTION That a variation from the strict provisions of Article 2.2 -2
THREE: of the Zoning Ordinance of the Village of Deerfield, passed
April. 17, 1978, as amended, with respect to the property here -
inabove described, is hereby granted so as to permit two lots having a lot
area of 6,250 square feet in lieu of the required 9,000 square feet and
having a lot width of 50 feet in lieu of the required 75 feet and to permit
the existence of a non - conformity as to the existing structure on Lots 51
and 52 in that the total side yard will be 12.57 feet in lieu of the
required 20 foot width, neither side yard meeting the required 8 foot
minimum, all in accordance with plans presented and filed with the Zoning
Board of Appeals.
SECTION That the variations hereby granted are subject to compliance
FOUR: by the Petitioners with all other applicable provisions of
the Zoning Ordinance and with all other applicable ordinances
of the Village of Deerfield.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage, approval and publication, as provided
by law.
