O-78-24ORDINANCE NO. 0 -78- 24 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1024 WAYNE AVENUE, DEERFIELD, ILLINOIS WHEREAS, CHESTERFIELD DEVELOPMENT CORP. has petitioned for a variation from the strict provisions of Ordinance No. 0- 76 -56, Section 4, of the Village of Deerfield, to permit a front yard of 26.5 feet in lieu of the required 30 feet to permit the completion of construction of a single family residence; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and report. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the failure to make a recommendation by the Zoning ONE: Board of Appeals is not concurred in and adopted by the President and Board of Trustees. SECTION That the President and Board of Trustees has determined TWO: that there are practical difficulties and particular hardships in the way of carrying out the strict letter of the provisions of Ordinance No. 0- 76 -56, Section 4, of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 15, Block 3 in the Laurel Hill North Subdivision being a re- subdivision in the East 1/2 of the Northeast 1/4 of the Southwest 1/4 of Section 29, Township 43 North, Range 12 East of the Third Principal Meridian, all in Lake County, Illinois, and commonly known as 1024 Wayne Avenue. SECTION That a variation from the strict provisions of Ordinance No. THREE: 0- 76 -56, Section 4, of the Village of Deerfield, with respect to the property hereinabove described, is hereby granted so as to authorize the completion of construction of a single family residence, thereby permitting a front yard of 26.5 feet in lieu of the required 30 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by FOUR: the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. y.• SECTION That this ordinance shall be in full force and effect from FIVE: and after its passage and approval, as provided by law.
