O-77-84ORDINANCE NO. 0- 77 -84_�, AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 920 HOLLY COURT, DEERFIELD, ILLINOIS WHEREAS, MR. AND MRS. BARRY SIEGAL have petitioned for a variation from the strict provisions of Sections VII and XVIII of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit construction of an addition resulting in a 24 foot front yard in lieu of the required 30 feet, said variation resulting in the expansion of an existing non - conforming structure having a rear yard of 18 feet in lieu of the required 25 feet and a corner side yard of 10 feet in lieu of the required 15 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning ONE: Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hardships TWO: in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioners' property, which is legally described as follows: Lot 37 in Birchwood Builder's Inc., addition to Deerfield, being a subdivision in the southeast 1/4 of Section 29, Township 43 North, Range 12 East of the Third Principal Meridian, in Lake County, Illinois. SECTION That a variation from the strict provisions of Sections VII THREE: and XVIII of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property hereinabove described, is hereby granted so as to authorize the construction of an addition, thereby permitting a 24 foot front yard in lieu of the required 30 feet, resulting in the expansion of an existing non - conforming structure having a rear yard of 18 feet in lieu of the required 25 feet and a corner side yard of 10 feet in lieu of the required 15 feet, in accordance with the recom- mendations of the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by FOUR: the Petitioners with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village of Deerfield. SECTION That this ordinance shall be in full force and effect from FIVE: and after its passage and approval, as provided by law. AYES: Blumenthal, Gavin. Heisler, LarLy.
