ORDINANCE NO. 0 -77 -61 AN ORDINANCE AUTHORIZING A SPECIAL USE FOR A SYNAGOGUE WITH ACCESSORY USES AS A RELIGIOUS SCHOOL, DAY NURSERY AND CHILD CARE CENTER AT BRIARWOOD SCHOOL WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the BOARD OF EDUCATION OF SCHOOL DISTRICT 109 and the DEERFIELD PARK DISTRICT to authorize the use and occupancy of Briarwood School, Deerfield, Illinois, and hereinafter described, for a synagogue with accessory uses as a religious school, day nursery and child care center, under and pursuant to the provisions of Section XXIII,B,5,b of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Com- ONE: mission are concurred in and adopted as the findings of the President and Board of Trustees and the special use of the real estate legally described in the Notice of Hearing attached hereto and made a part hereof, to include a synagogue with accessory uses as a religious school, day nursery and child care center, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said special use TWO: hereby given is subject to the requirements that all use, construction and development shall be in accordance with all plans and representations submitted and made by Applicants to the Plan Commission and President and Board of Trustees, is subject to compliance by Applicants with all other applicable provisions of the Zoning Ordinance, specifically including but not limited to the off - street parking requirement imposed by Section XVI,F,4,b thereof, and all other applicable ordinances of the Village of Deerfield, and is further subject to the requirement that the enrollment of the day nursery and child care center be limited to a maximum of g.tFO-- children. 60 Changed 10/3/77 SECTION That the approval and authorization of said special use THREE: hereby given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicants.
