O-77-65ORDINANCE NO. 0 -77- 65 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 17th day of October , 1977 by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0 -77- 65 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD . BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 22- 1(a)(2) of the Municipal Code of the ONE: Village of Deerfield of 1975, as amended, be and the same is hereby further amended by striking said sub- section in its'entirety and substituting in lieu thereof the following: "(a)(2) Bicycle. Every device propelled by human power upon which any person may ride, having two tandem wheels, either of which is 16 inches or more in diameter." SECTION That Section 22- 117(a) and Section 22- 117(c) of the Muni - TWO: cipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by striking said subsections in their entirety and substituting in lieu thereof the following: "Section 22 -117. Registration.required. (a) It shall be unlawful for any person who resides within the Village and the operators of any bicycle rental agency within the Village to own or ride, or propel a bicycle on any public street, roadway, alley, sidewalk or other public way within the Village unless said bicycle has first been registered, an.'identification tag attached thereto, and the number of the identification tag engraved on the frame of the bicycle, as hereinafter provided in this Section. (c) Upon receipt of the application and upon acceptance of the matter set forth in said application, the Chief of Police or other person authorized by him shall affix a suitable identification tag or emblem to the bicycle in a conspicuous place so the same may be visible at all times and engrave the registration number on the frame of the bicycle as provided in Section 22- 117(a). Such iden- tification tag or emblem shall be transferable from person to person in the case of sale of the bicycle, but shall not be transferable from bicycle to bicycle." SECTION That Section 22- 117(d) of the Municipal Code of the Village THREE: of Deerfield of 1975, as amended, be and the same is hereby repealed. SECTION That Section 22- 121(b) and Section 22- 121(d) of the Municipal FOUR: Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by striking said sub- sections in their entirety and substituting in lieu thereof the following: "(b) Brakes. Every bicycle shall be equipped with a brake adequate to control movement of and stop and hold such bicycle. (d) Sirens Prohibited. No bicycles shall be equipped nor shall any person use upon any bicycle any siren, gong or whistle." SECTION That Section 22- 121(e)(1) of the Municipal Code of the FIVE: Village of Deerfield of 1975, as amended, be and the same is hereby further amended by striking said subsection in its entirety and substituting in lieu thereof the following: "(1) No person shall sell a bicycle that is not equipped with the equipment provided for in Section 22- 121(b) and that portion of Section 22- 121(c) dealing with reflectors." SECTION That Section 22 -128 of Chapter 22 of the Municipal Code SIX: of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended by adding the follow- ing at the conclusion thereof: "If in the course of performance of the enforcement duties prescribed in this Article a police officer shall issue a "warning notice" rather than a "violation citation" to a bicycle operator due to the failure of said bicycle operator to have the safety equipment required by Section 22 -121, as amended, installed on his bicycle, said warning notice shall require that the bicycle operator exhibit compliance with Section 22 -121, as amended, at the Village of Deerfield Police Depart- ment within seven days after issuance of said warning notice. Failure to comply with the foregoing provision shall constitute a separate offense pursuant to this Article, and the bicycle operator in violation of this Section shall be issued a violation citation therefor." SECTION That the Village Clerk is hereby directed to publish this SEVEN: ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict here - EIGHT: with are, to the extent of such conflict, hereby repealed. SECTION That this ordinance shall be in full force and effect from NINE: and after its passage, approval and publication as provided by law.
