O-77-49ORDINANCE NO. 0 -77 -49 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 341 PINE STREET, DEERFIELD WHEREAS, JAMES A. AUDO has petitioned for a variation from the strict pro- visions of Section VII,C,2 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit a 6 foot side yard in lieu of the required 8 feet; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and negative recommendation of ONE: the Zoning Board of Appeals are not concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hardships TWO: in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 2 in the Third Addition to Deerfield Park, Unit #1, being a sub- division in the West 1/2 of the Southeast 1/4 of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, according to the Plat thereof recorded December 22, 1958 as Document 1015141 in Book 34 of Plats, page 96, in Lake County, Illinois. SECTION That a variation from the strict provisions of Section THREE: VII,C,2 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property hereinabove described, is hereby granted so as to authorize the construction of a garage thereby permitting a 6 foot side yard in lieu of the required 8 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by FOUR: the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village. SECTION That this ordinance shall be in full force and effect FIVE: from and after its passage and approval as provided by law.
