ORDINANCE NO. 0 -77- 53 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE FIRST PRESBYTERIAN CHURCH ALTERATION OF EXISTING CHURCH FACILITIES WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of the FIRST PRESBYTERIAN CHURCH to amend an existing Special Use Permit to authorize the use and occupancy of a portion of the First Presbyterian Church, Deerfield, Illinois, and hereinafter described, for a two bedroom apartment to be occupied by a church staff mem- ber, under and pursuant to the provisions of Sections XII and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Com- ONE: mission are concurred in and adopted as the findings of the President and Board of Trustees and the amended special use of the real estate legally described as follows: Lot 3, Block 2 of the Plat of the Town of Deerfield in the S.W. 1/4 of Sec. 28 - T43N - R12 E of the 3rd PM located 231' north of the SW corner of said SW '1/4 to the point of beginning of said lot thence N for 209' -10 5/8" thence E 34' -04" N. 367' -2 3/8" thence S 11 ° -38'- 23" E, 214' -6" thence W 32' -15" N 412' -6 3/4" to said point of begin- ning. Recorded March 16, 1857, Book 27 Deeds P. 167 by Oran Risley, Surveyor = as shown on Sheet 4, P. 1 of 2, Plat of the Village of Deerfield. to include a two bedroom apartment to be occupied by a church staff member, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said special use TWO: hereby given is subject to the requirements that all use, construction and development shall be in accordance with all plans and representations submitted and made by Applicant to the Plan Commission and President and Board of Trustees, is subject to compliance by Applicant with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield, and is further subject to the requirement that the apartment described herein may only be occupied by a church staff member. SECTION That the approval and authorization of said special use THREE: hereby given is subject to the requirement that.this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Applicant. SECTION That the Village Clerk is hereby directed to publish FOUR: this ordinance in pamphlet form. SECTION That this ordinance shall be in full force and effect FIVE: from and after its passage, approval and publication as provided by law.
