R-76-67ORDINANCE NO. 0 -76 -67 J„816636 AN ORDINANCE AUTHORIZING A SPECIAL USE (WHITEHALL NORTH NURSING HOME) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of WHITEHALL NORTH CONVALESCENT HOME PARTNERSHIP to authorize the use and occupancy of certain real estate commonly known as 250 Waukegan Road, Deerfield, Illinois, and hereinafter described, for a nursing home as a special use under and pursuant to the provisions of Sections XIII,D,3,n, XIII,D,4, XIII.,D,5 and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was,held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact including express affirma- tive findings of compliance with the provisions of Sections XIII,D,5 and XXIII, B,3, of the Village Zoning Ordinance and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth; and . WHEREAS, pursuant to Ordinance 72 -20, the Village of Deerfield had pre- viously permitted, as a special use, the use of a portion of the real estate for a nursing home, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendations of the Plan Commission ONE: are concurred in and adopted as the findings of the President and Board of Trustees and the special use of Lots 1 and 2 in Golf -View Subdivision, being a Subdivision of part of the South West quarter of Section 33, Township 43 North, Range 12, East of the Third Principal Meri- dian, according to the plat thereof, recorded May 25, 1972, as Document 1559281, in Lake County, Illinois, as and for a nursing home subject to the. conditions and restrictions hereinafter set forth, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said special use TWO: hereby given is subject to compliance by Petitioner with all other applicable ordinances of the Village of Deerfield and is subject to the following further conditions: A) That the building housing the proposed nursing home shall not have a ground floor area in excess of 93,000 square feet nor have in excess of 243 patient beds and that the building and premises shall, in all respects, conform with plans and speci- fications submitted to the'Plan Commission of the Village of Deerfield and to other representations made by the Petitioner to the Plan Commission. F 1816636 B) That the Petitioner provide not less than 94 parking spaces and designate areas sufficient to accommodate 8 additional parking spaces within the real estate which shall remain avail- able for parking use at such time as the Village of Deerfield may determine. C) That the configuration of the driveway entrances to the subject property shall generally conform to the configuration depicted as Plan B on the Exhibit to the report prepared by Paul Box & Associates dated December 20, 1976, and submitted to the Board of Trustees. SECTION That the approval and authorization of said special use hereby THREE: given is subject to the requirement that this Ordinance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and expenses incurred therefor shall be paid by the Petitioner. � SECTION That all ordinances or parts of ordinances in conflict herewith FOUR: are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to publish this FIVE: ordinance in pamphlet form. SECTION That this ordinance shall be in full force and effect from SIX: and after its passage, approval and publication as provided by law.
