O-77-55ORDINANCE NO. 0 -77- 55 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD Published in pamphlet form this 6th day of September 1977, by the President and Board of Trustees of Deerfield. ORDINANCE NO. 0-77-55 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD WHEREAS, the President and Board of Trustees in response to widespread community interest, have made a study of the question of adequate housing for senior citizens; and WHEREAS, the Plan Commission of-,,the Village of Deerfield has con- ducted a public hearing upon the subject matter of an amendment to the Zoning Ordinance regarding senior citizen housing and has furnished its recommendations to the President and Board of Trustees; and WHEREAS, there exists within the Village a shortage of housing for the elderly with suitable amenities, available at low and moderate rentals to Village residents and their families who are single elderly persons 62 or more years of age, or who are couples and households of two persons, where one is at least 62 or more years of age, and who have low and moderate income as defined by current federal and state standards, and as defined by their inability to pay for such housing in the open market; and WHEREAS, the shortage of housing for the elderly is detrimental to the safety, health, morals, and welfare of the residents of this Village, and to the maintenance of a sound family and community life; and WHEREAS, neither private enterprise and investment nor local govern- ment are disposed to nor can they economically achieve the needed construction of housing for the low and moderate income elderly at rentals they can afford, without an amendment to the Zoning Ordinance designating such housing as a special use in certain zoning districts which may be granted with conditions permitting exceptions to the regulations of the zoning district and other provisions of the Zoning Ordinance, including, but not limited to, building height, lot coverage, areas, including lot area and yard requirements, dwelling units per acre, bulk, dwelling standards, off - street parking and loading, and such other conditions as the Board of Trustees may require, providing, however, that such use shall be so designated and located as to exercise no undue detrimental influence upon surrounding properties; and WHEREAS, the public interest, necessity, and convenience clearly will be served by amending the Zoning Ordinance to permit the construction of such housing under regulations which will provide reasonable protection to sur- rounding property, will give occupancy preference to Deerfield residents and their families to the extent permitted by federal and state law and regulations, and which will assure continued compliance with the conditions of the special use and perpetual use of the property for housing for the low and moderate income elderly until terminated by consent of the Board of Trustees, or by operation of law. NOW, THEREFORE, BE.JT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF,DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section XXIII,B of the Zoning Ordinance of the Village ONE: of Deerfield, as amended, enumerating Special Uses available in various zoning districts, is further amended by adding Subsection (E) thereto including "Housing for the Elderly" as a Special Use in that portion of the Village of Deerfield described in Section XIII, A,3 and commonly referred to as the "Central Business District ", which may be granted with conditions permitting exceptions to the regulations of the underlying zoning district and other provisions of the Zoning Ordinance, within the boundaries of said elderly housing development, including building height, lot coverage, areas, including lot area and yard require- ments, dwelling standards, off - street parking, loading and such other conditions as the Board of Trustees may require. SECTION That Section III of the Zoning Ordinance of the Village of TWO: Deerfield, as amended, entitled "Definitions ", is further amended by adding thereto the following: "HOUSING FOR THE ELDERLY: For the purposes of this zoning ordinance, this term shall mean new construction of multiple - family dwelling units or remodeling of. existing multiple - family dwelling units, the occupation of which shall be limited to persons 62 years of age or more; provided that if two or more persons occupy a unit, at least one shall be.62 years of age or more. Preference for occupation of this type of housing shall be accorded to residents of Deerfield and their families to the extent permitted by state and federal laws and regulations. Any special use permit authorizing construction or conversion of Elderly Housing units shall contain provisions setting forth the foregoing requirements and restrictions." SECTION That the Village Clerk is hereby.directed to publish this THREE: ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in conflict here - FOUR: with are, to the extent of such conflict, hereby repealed. SECTION That this ordinance shall be in full force and effect from FIVE: and after its passage, approval and publication as provided by law.
