O-77-35ORDINANCE NO. 0 -77- 35 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 440 WILLOW AVENUE WHEREAS, DAVID JENNINGS has petitioned for a variation from the strict pro- visions of Sections VII,C,2, VII,C,3 and XVII,E of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit a rear yard of 20 feet in lieu of the required 25 feet to an existing structure having an existing side yard of 7.2 feet in lieu of the required 8 feet to permit the construction of a room addition; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the Zoning ONE: Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hardships TWO: in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property, which is legally described as follows: Lot 45 in Second Addition to Deerfield Park being a subdivision of part of the South 1/2 of the Northwest 1/4 of Section 32, Township 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois. SECTION That a variation from the strict provisions of Sections THREE: VII,C,2, VII,C,3 and XVII,E of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property hereinabove described, is hereby granted so as to authorize the construction of a room addition thereby permitting a rear yard of 20 feet in lieu of the required 25 feet, and a side yard of 7.2 feet in lieu of the required 8 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance by FOUR: the Petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village. SECTION That this ordinance shall be in full force and effect FIVE: from and after its passage and approval as provided by law. AYES: Blumenthal, Gavin, Heisler, Marty.., Seidman, Swanson..
