AN ORDINANCE AMENDING CHAPTER 3
OF THE MUNICIPAL CODE OF THE
VILLAGE OF DEERFIELD OF 1975
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section 3 -1 of Chapter 3 of the Municipal Code of
ONE: the Village of Deerfield of 1975, as amended, be and the
same is hereby further amended by striking the definition
of "Restaurant" contained in said Section in its entirety and substituting
in lieu thereof the following:
"(6) Restaurant: Any public place kept, used, maintained, advertised
and held out to the public to be a place where meals are served, and
where meals are actually and regularly served, without sleeping
accommodations, such space being provided with adequate and sanitary
kitchen and dining room equipment and capacity and having employed
therein a sufficient number and kind of employees to prepare, cook
and serve suitable food for its guests.
Provided further that no restaurant licensees shall sell
alcoholic liquor except when full meal service is available.
A public place shall not be a restaurant within the meaning of
this definition if in addition to the foregoing more than twenty
percent (20 %) of the square footage contained in the total premises
is employed for the service and /or storage of alcoholic liquor or
if the proportion of the total square footage contained in the
premises and employed for the service and /or storage of alcoholic
liquor exceeds thirty three percent (33 %) of the square.footage
contained in the total premises which is devoted primarily to the
regular preparation and service of meals."
SECTION That all ordinances or parts of ordinances in conflict
TWO: herewith are, to the extent of such conflict, hereby
repealed.
SECTION That the Village Clerk is hereby directed to publish this
THREE: ordinance in pamphlet form.
SECTION That this ordinance shall be in full force and effect
FOUR: from and after its passage, approval and publication
as provided by law.
