AN ORDINANCE AMENDING SECTIONS 2 -136
AND 2 -137 OF CHAPTER 2 OF THE
MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD OF 1975
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section 2 -136 of Chapter 2 of the Municipal Code of
ONE: the Village of Deerfield of 1975, as amended, be and the
same is hereby further amended by striking said Section
2 -136 in its entirety and substituting in lieu thereof the following:
"Sec. 2 -136. Appointment of Board of Building Appeals; vacancies;
removal.
(a) There is hereby established a Board of Building Appeals,
consisting of seven (7) members who shall be appointed by the President
by and with the advice and consent of the Board of Trustees. The Presi-
dent by and with the advice and consent of the Board of Trustees shall
appoint one of the members of the commission to serve as chairman.
(b) With respect to original appointments, the President has with
the advice and consent of the Board of Trustees appointed one (1) member
of the Board of Building Appeals for a term of one (1) year, one (1)
member for a term of two (2) years, one (1) member for a term of three
(3) years, one (1) member for a term of four (4) years and one (1)
member for a term of five (5) years. Additional appointees required
as a result of a change in the number of members of the Board of Building
Appeals shall be appointed for a term of five (5) years.
(c) Upon expiration of the term of office of a member of the
Building Board of Appeals, his successor shall be appointed for a
term of five (5) years. Vacancies shall be filled for an unexpired
term in the manner in which the original appointments are required to
be made. Continued absence of any member from regular meetings of the
Board shall, at the discretion of the President and Board of Trustees,
render any such member liable to immediate removal from office by the
President."
SECTION That Section 2 -137 of Chapter 2 of the Municipal Code of
TWO: the Village of Deerfield of 1975, as amended, be and the
same is hereby further amended by striking said Section
2 -137 in its entirety and substituting in lieu thereof the following:
"Sec. 2 -137. Quorum; voting requirements.
Four (4) members of the Board of Building Appeals shall constitute a
quorum. In recommending any change or amendment of any provision of
the Building Code or in recommending a modification of an order of the
Building Commissioner, affirmative votes of four (4) members shall be
required. No member of the Board of Appeals shall pass upon any question
in which he is interested."
SECTION That the Village Clerk is hereby directed to publish this
THREE: ordinance in pamphlet form.
SECTION That all other ordinances or parts of ordinances in conflict
FOUR: herewith are, to the extent of such conflict, hereby repealed.
SECTION That this ordinance shall be in full force and effect from
FIVE: and after its passage, approval and publication as provided
by law.
