O-77-04m ORDINANCE NO. 0 -7.7- 4 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 1563 HAWTHORNE PLACE. DEERFIELD WHEREAS, STEEN AND JEAN LARSEN have petitioned for a variation from the strict provisions of Sections VII,C,2 and XVIII,E of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit a 7.6 foot corner side yard in lieu of the required 15 feet and to permit the con- struction of an addition on the non - conforming residence; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the ONE: Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hard - TWO: ship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to petitioner's property which is legally described as follows: Lot 17 of Block 3 of Branigar Brothers Woodland Park, a subdivision of parts of the north 1/2 of Section 29, Town- ship 43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois. SECTION That a variation from the strict provisions of Sections THREE: VII,C,2 and XVIII,E of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended with respect to the property hereinabove described, is hereby granted so as to authorize the construction of an addition to a presently non - conforming residence and permitting a 7.6 foot corner side yard in lieu of the required 15 feet, all in accordance with the recommendations of the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance FOUR: by the petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village. SECTION That this ordinance shall be in full force and effect from FIVE: and after is passage and approval, as provided by law.
