O-76-51ORDINANCE NO. 0 -76 -51 AN ORDINANCE AUTHORIZING A SPECIAL USE (A DAY NURSERY AT 963 FOREST AVENUE) Published in pamphlet form this 4th day of October , 1976, ,by the President and Board of Trustees of Deerfield. 1 ORDINANCE NO. 0 -76- 51 AN ORDINANCE AUTHORIZING A SPECIAL USE (A DAY NURSERY AT 963 FOREST AVENUE) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application.of Mr. and Mrs. Willard Meintzer, to authorize the use and occupancy of certain real estate commonly known as 963 Forest Avenue, Deerfield, Illinois, and hereinafter described, for a day nursery as a special use under and pursuant to the provisions of Sec- tions VII and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after consi- dering the evidence adduced, made written findings of fact and-recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendation of-the Plan Commission ONE: are concurred in and adopted as the findings of'the President and Board of Trustees and the special use of the real estate legally described as follows: Lot 20, 21 and 22 in Block 16 in Deerfield Park Land and Improvement Association's Subdivision in the Southeast 'a of Section 29, Township .43 North, Range 12, East of the 3rd P.M. in Lake County, Illinois. as and for a day nursery, be and the same is hereby authorized and approved. SECTION That the approval and authorization of'said special use hereby TWO: given is subject to compliance by Applicants with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield, and is further subject to a time limitation of six years from the effective date hereof, at which time the authorization of said special use shall lapse'or terminate unless re- newed or extended by the President and Board of Trustees in the manner provided by law. SECTION That the approval and authorization of said special use THREE: hereby given is subject to the requirement that this Ordi- nance shall be recorded in the Office of the Recorder of Deeds of Lake County, Illinois, and all fees for such recordation and ex- penses incurred therefor shall be paid by the Applicants. SECTION That the Village Clerk is hereby directed to.publish FOUR: this Ordinance in pamphlet form. SECTION That this Ordinance shall.be in full-force-and effect FIVE: from and after its passage, approval and.publication as provided by law.
