O-76-56ORDINANCE NO. 0 -76- 56 AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS OF THE ZONING ORDINANCE WHEREAS, CHESTERFIELD DEVELOPMENT CORPORATION has petitioned for certain variations from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4', 1953, as amended, with respect to certain real estate located in the Village of Deerfield and hereinafter described on Ex- hibit A attached hereto an d made a part hereof; and WHEREAS, pursuant to notice duly published, as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of'the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees.its written findings of fact and.recommendations; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,'ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the ONE: Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hard - TWO: ships in the way of carrying out the strict.letter of the provisions of the Zoning Ordinance of the Village of Deerfield, as applied to the Petitioner's property, which is legally described on Exhibit A attached hereto and made a part hereof. SECTION That variations from the strict provisions of Sections VII,C,2 THREE and VII,C,5 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property herein described on Exhibit A attached hereto and made a part hereof, are hereby granted so as to permit: 1. A combined total of side yard of not less than 18 feet, in lieu of the required total of not less than 20 feet. 2. A lot area of less than the required 9,000 square feet and a width at the established building line of less than the required 75 feet, all in accordance with the Preliminary Plat of Resubdivision dated October 12, 1976, referred to as Study No. 12A and attached to and made a part hereof as Exhibit B. r SECTION That the variations hereby granted are subject,to compliance FOUR: by Petitioner with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village, and, further., prior-to the approval.of the Final Plat of Resubdivision, Petitioner shall be required to grant the.Village of Deerfield a perpetual 30 foot easement measured westerly from the front lot lines of those lots fronting on Wayne Avenue and lying south of Somerset Avenue, for the purpose of installa- tion thereon of'a public parkway and sidewalk. In addition, the granting of the above - described variations is conditioned upon the establishment of a 30 foot building line on the said Preliminary and Final Plat of Resubdivision with .respect to those lots fronting on Wayne Avenue lying south of Somerset Avenue. SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage and approval as provided by law.
