O-76-65ORDINANCE NO. 0-76-65 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 704 ORCHARD STREET, DEERFIELD WHEREAS, ALBERT EASTON has petitioned for a variation from the strict provisions of Sections VII,C,2 and XVIII,E of the Zoning Ordinance of the Village'of Deerfield, passed May 4, 1953, as amended, to permit construction of an addition resulting in a 4.8 foot side yard in lieu of the required 15 feet, even though the existing structure lies 4.54 feet from the property line; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations of the ONE: Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular hard - TWO: ship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to petitioner's property which is legally described as follows: Lot 7 in Owner's Homestead Subdivision, being a subdivision in the southwest 1/4 of Section 28, Township 43 North, Range 12, East of the Third Principal Meridian, according to the plat thereof recorded December 11, 1922 as Document 218864 in Book "L" of Plats, page 22, in Lake County, Illinois. SECTION That a variation from the strict provisions of Sections THREE: VII,C,2 and XVIII,E of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended with respect to the property hereinabove described, is hereby granted so as to authorize the construction of an addition to a presently non - conforming residence thereby permitting a 4.8 foot side yard in lieu of the required 15 feet, all in accordance with the recommendations of the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to compliance FOUR: by the petitioner with all other applicable provisions of the Zoning Ordinance and with all other applicable ordinances of the Village. SECTION That this ordinance shall be in full force and effect from FIVE: and after is passage and approval, as provided by law.
