O-76-33MC:PB:6.3.76 ORDINANCE NO. 0 -76 -33 AN ORDINANCE TO PROVIDE FOR A LOCAL IMPROVEMENT CONSISTING OF THE INSTALLATION OF SANITARY SEWERS AND OTHERWISE IMPROVING A PORTION OF WAUKEGAN ROAD AND NORTHWOODS ROAD IN THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION A local improvement sha'11 be constructed in ONE: the Village of Deerfield, Illinois, consisting of the installation of sanitary sewer, the restoration of parkways, grading and seeding, and such other incidental work that may be necessary to complete the im- provement to the following streets in the manner, as modified, and hereinafter described, to -wit: On Waukegan Road, on the westerly side thereof, com- mencing at a point 730 feet north of Greenwood Avenue and continuing northward to a point approximately 305 feet south of Hunter Court; an approximate total dis- tance of 1,142 feet. On Waukegan Road the improvement consists of installing 1,142 linear feet of 8" sanitary sewer pipe of extra strength vitrified clay and of ductile iron in steel casing for a distance of 55 linear feet under the roadway pavement: including backfill, pavement removal and replacement, grading and seeding; restoration .of such driveway and parkway areas where necessary and accomplishing such other incidental work as may be necessary to complete the improvement. On Northwoods Road, on the south side thereof, com- mencing at its intersection with Waukegan Road and continuing eastward for an approximate total distance of 200 feet. On Northwoods Road the improvement consists of installing approximately 165 linear feet of 8 inch extra strength vitrified clay sanitary sewer pipe to connect to ductile iron in steel casing pipe beneath Waukegan Road pavement; together with necessary driveway and parkway restoration and other incidental work as may be necessary to complete the improvement. All of said streets being located in Deerfield, in Lake County, Illinois: SECTION That said improvement shall be constructed, TWO: and the details concerning the same shall be in accordance with the Plans and Special Provisions and specifications entitled "Village of Deerfield Special Assessment No. 113 - Waukegan Road Sanitary Sewer Improvement ", attached hereto and made a part hereof. SECTION That all materials of every kind used in THREE: the construction of this improvement shall be of first class quality and suitable for the purpose for which they are to be used.' All construction shall be done in a workmanlike manner, under the supervision and subject to the approval of the Board of Local Improvements. SECTION That the Recommendation of the Board of Local FOUR: Improvements of this Village providing for this improvement, together with the Estimate of the cost thereof made by the President of said Board, both attached hereto, are herein approved. SECTION That the improvement herein provided to be FIVE: constructed shall be made, and the whole cost thereof including $2,487.14, being the amount included in the Estimate of the President of the Board of Local Improvements as the cost of making, levying, and collecting the assessment herein with an additional amount of $ ,_ included as reserve for deficiency in interest, shall be paid for by special assessment in accordance with Article 9, Division 2, of the Illinois Municipal Code, approved May 29, 1961, and the amendments thereto; and $ shall be applied toward the cost of making, levying and collecting such assessment and an additional $ shall be retained and used as reserve for payment of de- ficiency in interest. Each said amount does not itself exceed 6% of the amount of the assessment as estimated. SECTION The aggregate amount herein ordered to be SIX:. assessed against the property, and also the assessment on each lot and parcel of land therein assessed, shall be divided into ten (10) installments in the manner provided by the Statute aforesaid, and each of said installments shall bear interest at a rate not to exceed 7% per annum according to law, until paid. SECTION That for the purpose of anticipating the SEVEN: collection of the second and succeeding installments of said assessment for said installments, bearing interest at a rate not to exceed 7% per annum, payable annually and signed by the President of the Village of Deerfield, and attested by the Village Clerk under the corporate seal of the Village of Deerfield. Said Vouchers or bonds shall be issued in accordance with and shall in all respects conform to the provisions of the aforesaid statute of the State of Illinois entitled, "Municipal Code," and the amendments thereto. SECTION That the Village Attorney is directed to file EIGHT: a Petition in the Circuit Court of Lake County, Illinois, in the name of the Village of Deerfield, praying that steps may be taken to levy a special assessment for said improvement in accordance with the pro- visions of this Ordinance in the manner prescribed by law. SECTION That all ordinances or part of ordinances NINE: in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That this:*Ordinance shall be in full force TEN: and effect from and after its passage and approval as provided by law. As you will recall, at the meeting at which Ordinance 76 -31 was adopted, numerous changes were approved and were to be inserted in the final draft of the Ordinance. It seemed the most effective way of accomplishing the Kuhn licensing by including it in the final revision. We have also noted our records to reflect the recision of Ordi- nance 76 -34 being the granting of the one day liquor license to Family Day, Inc.
