O-76-36ORDINANCE NO. 0 -76 -36 RECAPTURE ORDINANCE, LOT 71 WHEREAS, HELEN HOLZMACHER,. who is the owner or party interested in the property described as follows: Lot 71 in the subdivision.of J. S. Hovland's First Addition to Deerfield, a subdivision of the Southwest Quarter (except the Northwest Quarter of the Northwest Quarter thereof) of Section 32, Township 43 North, Range 12 East of the Third Principal Meridian, as shown on the Plat of said Subdivision recorded Novem- ber 7, 1924, as Document 248380 in Lake County, Illinois. and has caused to be constructed by private contract and has paid the cost thereof of an underground improvement consisting of a water main extension in certain portions of Laurel Avenue in said subdivision in the Village of Deerfield; and WHEREAS, said improvement so constructed is available to and may be of benefit to adjoining and adjacent properties; and WHEREAS, the construction of said improvement by private contract provides a substantial.saving in cost to any person or property owner having present or future use and benefit thereof, as compared with the cost of the construction of such improve- ment by special assessment. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That no person, firm or corporation, excepting ONE: Helen Holzmacher, shall connect to or obtain service (except for fire protection) from the six -inch (6 ") water main constructed and installed by Helen Holzmacher in Laurel Avenue east of Birchwood Avenue and directly south of the subject property without first obtaining a permit for such connection or service. No such permit shall be issued unless the applicant shall give evidence to the Village of Deerfield of payment to Helen Holzmacher or her successors and assigns, of such person's, firm's or corporation's propor- tionate share of -the cost of such improvement as shown on the attached schedule which is made a part of this Ordinance. Such payment:to Helen Holzmacher shall be.in addition to the usual charges and fees payable to the Village for the issuance of such a permit. e SECTION That no planned development of Lot 70 in TWO: J. S. Hovland's First Addition to the Village of Deerfield shall be approved pursuant to the applicable provisions of the Village Zoning Ordinance unless as a condition of such approval, the applicant shall be required to pay..his proportionate share of the cost of the six -inch (6 ") water main constructed and installed by Helen Holzmacher in Laurel Avenue immediately east of its intersection with Birch- wood Avenue in accordance with the attached schedule. SECTION That the foregoing provisions of this Ordinance THREE: shall terminate ten (10) years after the date of passage. SECTION That this Ordinance shall be in full force and FOUR: and effect from and after its passage and approval as provided by law.
