AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE
ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS
49 •WAUKEGAN ROAD, -DEERFIELD
WHEREAS, Phil Johnson, Inc. has petitioned for a variation
from the strict provisions of Sections XIII,G,1, XVI,F,10, and
XVIII,E of the Zoning Ordinance of the Village of Deerfield,
passed May 4, 1953, as amended, to permit the structural alteration
of an existing non - conforming building resulting in a front yard
of 2.93 feet and 47.50 feet, both in.lieu of the required 50
feet, and the redevelopment of the existing parking lot to permit
parking spaces within 2, 5 and 10 feet from the property line in
lieu of the required 50 foot set back; and
WHEREAS, pursuant to notice duly published as required by
statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendations;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations
ONE: of the Zoning Board of Appeals are hereby con-
curred in and adopted\as the findings of fact of
the President and Board of Trustees.
SECTION That there are practical difficulties and parti-
TWO:, cular hardships in the way of carrying out the
strict letter of the provisions of the Zoning
Ordinance of the Village of Deerfield as applied to petitioner's
property which is legally described as follows:
That part of the Northwest quarter of the Northeast quarter
of Section 4, Township 42 north, Range 12 East of the Third
Principal Meridian, lying east of Public Road which runs
from Deerfield in Lake County to Shermerville in Cook
County, excepting therefrom that part of the northwest
quarter of the northeast quarter of Section 4, Township 42
north, Range 12 East of the Third Principal Meridian,
described as follows: Commencing at a point of the east
line of the northwest quarter of the northeast quarter of
said Section 4, 311.87 feet south of the northeast corner
thereof; thence south on the east line of the northwest
quarter of said northeast quarter 711.45 feet to an inter-
section with the center line of Waukegan Road; thence

northwesterly on the center line of Waukegan Road, 630.78
feet to a point 518 feet southeasterly of the intersection
of said center line with the north line of the northeast
quarter of Section 4; thence northeasterly on a line at
right angles with the center line of said Waukegan Road
329.06 feet to place of beginning, in Cook County, Illinois.
SECTION That a variation from the strict provisions of
THREE:. Sections XIII.,G,1, XVI,F,10, and XVIII,E of the
Zoning Ordinance of the Village of Deerfield,
passed May 4, 1953, as amended with respect to the property
hereinabove described, is hereby granted so as to authorize the
structural alteration of an existing non - conforming use thereby
resulting in a front yard of 2.93 feet and 47.50 feet, both in
lieu of the required 50 feet, and the redevelopment of the existing
parking lot to permit parking spaces within 2, 5, and 10 feet
from the property line in lieu of the required 50 foot setback,
all in accordance with the recommendations of the Zoning Board of
Appeals.
SECTION That the variations hereby granted are for the
FOUR: existing improvements and the life of the present
structure only, subject to receipt by the Director
of Building and Zoning of a Court Order indicating that the
transaction for highway improvements and curb -cuts as shown on
the plans presented to the Zoning Board of Appeals and.the Board
of Trustees between the State of Illinois and Phil Johnson, Inc.
has been finalized, and further subject to compliance by the
petitioners with all other applicable provisions of the Zoning
Ordinance and with all other applicable ordinances of the Village.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage and approval,
as provided by law.
