O-23-23VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-23 AN ORDINANCE AMENDING ARTICLE 1 OF CHAPTER 6 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED REGARDING BUILDING PERMIT FEES WHEREAS, the Village of Deerfield is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Article 1 of Chapter 6 of the "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Code'), establishes, among other things, the general requirements for building permit fees and exemptions from such fees; and WHEREAS, the Village now desires to eliminate the exemption paid by certain building permit applicants to more efficiently administer the Village's regulations; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village and its residents to amend the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO ARTICLE 1 OF CHAPTER 6 OF THE VILLAGE CODE. Section 6-7, titled "Public Buildings; Permit Fees; Exemptions; Charges," of Article 1, titled "In General," of Chapter 6, titled "Building," of the Village Code is hereby amended to read as follows: "Sec. 6-7. Public Buildings; Permit Fees; Exemptions; Charges: No building, plumbing or miscellaneous permit fees shall be charged for the issuance of permits for the construction of any public or parochial school, or any building used by a township, county, library, park district of any other taxing body, any church or building used for religious purposes or any governmentally assisted senior citizen housing project as that term is defined in the zoning ordinance. _ l.. ..... (00133510.11 {b4(a In lieu of the fees set forth in this chapter, the fee schedule shall be reduced by fifty percent (50%) for permits issued for construction of any building owned by a non-profit corporation and used for a continuing care retirement community as that term is defined in the zoning ordinance. {e� b In lieu of the fees set forth in this chapter, the fee schedule shall be reduced by twenty five percent (25%) for permits issued for construction of any building that is to be operated by a non-profit corporation for a minimum of ten (10) years from the permit issuance date and used for an independent living facility and a key component of a continuing care retirement community as that term is defined in the zoning ordinance. Except as modified hereby, the fee schedule contained in this chapter shall remain in force and effect. The applicant for any such permit shall pay the Village for meters, materials and labor furnished by the Village in connection with the issuance of such permits." SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
