O-23-22VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-22 AN ORDINANCE AMENDING ARTICLE 3 OF CHAPTER 21 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING LIENS FOR WEED CUTTING COSTS WHEREAS, the Village of Deerfield is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Article 3 of Chapter 21 of the "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Code's, regulates plants and weeds within the Village; and WHEREAS, the Village desires to eliminate the timeframe for which a lien must be recorded against a property for weed cutting costs to make the administration of its weed cutting regulations more efficient; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village and its residents to amend the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO ARTICLE 3 OF CHAPTER 21 OF THE VILLAGE CODE. Section 21-18, titled "Abatement; Lien For Weed Cutting Cost," of Article 3, titled "Plants and Weeds," of Chapter 21, titled "Trees and Vegetation," of the Village Code is hereby amended to read as follows: "Sec. 21-18. Abatement; Lien for Weed Cutting Cost: (b) Provided that the land is privately owned, the cost of cutting and removing such weeds shall also become a lien upon the real estate affected, until paid, superior to all other liens and encumbrances except tax liens; provided that within sixty days after such cost is incurred, the vVillage Manager files notice of lien in the office of the recorder of deeds of the county wherein the real estate is situated. Said notice of lien shall consist of a sworn statement setting out: 1) the description of {00133509.11 the real estate sufficient for identification thereof, 2) the amount of money representing the cost and expense incurred or payable for the service of cutting and removing such weeds, and 3) the date or dates when such cost or expense was incurred by the vVillage." SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
