O-23-21VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-21 AN ORDINANCE AMENDING ARTICLE 11 OF CHAPTER 6 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED TO REQUIRE CONSTRUCTION AND DEMOLITION SIGNAGE WHEREAS, the Village of Deerfield is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs; and WHEREAS, Chapter 6 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Code'), establishes, among other things, regulations related to demolition and construction in the Village; and WHEREAS, the Village desires to amend its construction and demolition regulations to require those engaging in such activities to post notice on the property to: (i) provide for more efficient communication in the event that there are code violations or any issues caused by the construction and demolition; and (ii) provide notice to neighbors that a property may be subject to demolition or construction activities; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village and its residents to amend the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO ARTICLE 11 OF CHAPTER 6 OF THE CODE. Section 6-70, titled "General Provisions," of Article 11, titled "Construction Management," of Chapter 6, titled "Building," of the Village Code is hereby amended to read as follows: "Sec. 6-70. General Provisions: (a) The applicant shall maintain the site and adjoining public ways and public property in a safe and clean condition, including, but not limited to, compliance with the minimum standards and requirements set forth herein for security fencing, protection of public property and landscaping, sanitation, facilities for the collection and removal of debris, traffic and parking control, loading and storage, until {00133413.2} construction of all improvements on the site has been completed and, if applicable, a certificate of occupancy has been issued. (b) Applicant shall provide the director of building and zoning with a telephone number for twenty four (24) hour emergency contact with the applicant or the general contractor. The size, shape, color. and text of such sign shall be as required by the Village Department of Community Development_Such sign must include notice of the permitted hours for demolition end construction. (de) As a condition of any building permit issued for a site, applicant authorizes the village and its officers, agents and employees, in the event of any emergency, accident or violation of this article that affects or threatens to affect the site to the detriment of public health, safety and welfare, to enter upon the site and to take such actions as may be reasonably necessary or appropriate to respond to the emergency, accident or violation of this article." SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
