ORDINANCE NO. 0 -74 -71 AN ORDINANCE PROVIDING FOR STANDARD SPECIFICATIONS FOR FACILITIES FOR THE HANDICAPPED BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That there is hereby adopted by the President and ONE: Board of Trustees for the purpose of establishing standard specifications for facilities for the handicapped, that certain Code attached hereto and made a part hereof to be known as the "Village of Deerfield Standard Specifications for Facilities for the Handicapped ", of which not less than three (3) copies have been and are now filed in the office of the Director of Building and' Zoning of the Village of Deerfield and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the corporate limits.of.the Village of Deerfield. SECTION That the Standard Specifications for Facilities for the TWO: Handicapped Code shall be enforced by the Director of Building and Zoning of the Village of Deerfield. SECTION That nothing in the Village of Deerfield Standard Specifications THREE: for Facilities for the Handicapped Code, as hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby, nor shall any right or remedy of any character be lost, impaired or affected by this ordinance. SECTION That the invalidity of any section or provision of FOUR: the Village of Deerfield Standard Specifications for Facilities for the Handicapped Code, as hereby adopted shall not invalidate other sections or provisions thereof. SECTION That the Village Clerk is hereby directed,to FIVE: publish this Ordinance in pamphlet form. SECTION. That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication as provided by law. Scope and Purpose A. Scope This standard applies to all- new buildings, additions to existing buildings, and to portions of buildings being structurally altered within the Village of Deerfield, except 1.. Single and two family residences 2.. Multiple family buildings if less than four stories- in height. 3. Any story above the first floor or basement level of non - residential buildings if the stories above the first floor or basement level are less than 15,000 square feet or unoccupied basement levels of any dimension... 4. When the addition or structural alteration does not exceed 25% of the floor area of the existing building. B. Purpose This standard is intended to make all buildings and facilities used by the public, accessible to and functional for the physically handicapped. II. Definitions A. Public Building, means: 1. A building, structure or improved area owned or leased by this state or its political subdivisions. 2. A building, structure or improve area used primarily by the general public as a place of gathering or amusement, including but not limited to theaters, restaurants, hotels and stadiums. 3. 1 (above) refers to public financing, in'.part or whole; 2 (above) refers to private financing, or public financing. B. Public Accommodation, means: A building, structure or improved area which is used primarily by the general public as a place of gathering or amusement, including theaters, restaurants, hotels, and stadiums. Note: This definitely includes outdoor areas, particularly those for recreation. C.- Handicapped Person Persons with reduced mobility, flexibility, coordination; or perceptiveness; due to age or physical condition. D. Facility for Handicapped Persons Includes any ramp, handrail, elevator, door, specially treated surface and similar design, convenience or device which facilitates the health, safety or comfort of a handicapped person. E. Structural Alteration, means: With respect to an existing building, to construct an addition or make substantial structural alteration that would prolong the life of the supporting members -2- of the bud ding or structure, such as bearing walls, columns, beams or girders -. F. Ramps, Ramps with Gradients Because the term "ramp" has a multitute of meanings and uses, its use in this text is clearly defined as ramps with gradients (or ramps with slopes) that deviate from what would otherwise be considered the normal level. An exterior ramp,' as distinguished from a "Walk" would be considered an appendage to a building leading to a level above or below existing ground level. As such, a ramp shall meet certain requirements similar to those imposed upon stairs. G. Walk, Walks Because the terms "walk" and "walks" have a multitute of meanings and uses, their use in this text .is clearly defined-as a predetermined, prepared surface,.exterior pathway leading to or from a building or facility, or from one exterior area to another, placed on the existing ground level and not deviating from the level of.the existing ground immediately adjacent. H. Parking Lots, means: Any area set aside to facilitate the parking of two or more vehicles and established for the use of the public, with or without charge for any of the following: 1. On grade or multiple "Level, 2. Open (outdoor) or enclosed structure,. 3. As a separate entity such as a privately operated lot for use by the public or a publicly owned and operated lot for use by the public, and -3- 4. As a part of or adjunct to a building, facility or public accommodation. III. Buildings, Facilities, Public Accommodations A. Entrances 1. All buildings will have a primary entrance for the handicapped. Primary entrance means a main entrance, no side or alley entrances for the handi- ..capped will be allowed. This means that the handi- capped will be able to maneuver themselves from the sidewalk directly into the building, enter the elevator and exit the elevator at floor they wish to visit or work. The'door checks on.the entrance doors will be designed so that the door can be opened without difficulty." The vestibule will be designed to allow 3'0" clear when one door is opened at ninety degrees. The width of the vestibule will be a minimum of 4'6 ". T.he minimum size of a vestibule will be 6'0" x 416 ". All doors serving habital rooms and grade level exits should be a minimum of 32" clear. B. Ramps with Gradients Where ramps with gradients are necessary or desired,. they shall conform to the following specifications: 1. A ramp shall not have a slope greater than one foot rise in twelve feet, or 8.33 percent, or 4 degrees 50 minutes. -4- 2. A ramp shall have handrails on at least one side, and preferably two sides, that are 32 inches in height, measured from the surface of the ramp, that are smooth, that extend 1 foot beyond the top and bottom of the ramp; and that otherwise conform with U.S.A. Standard Safety Codes for floor and wall openings, railings, and toe boards, A -12 -1932. Note: Where, for specific reasons, a code specifies handrails to be.'of heights other than 32 inches, it is recommended that two sets of.handrails be installed to serve all people. Note: Where major traffic is predominately children, particularly handicapped children, extra care should be exercised in the placement of handrails, in accordance.with the nature of the facility and the . age group or groups being serviced: Note: Care should be taken that the extension of the handrail is not in itself a hazard.. The extension may be made on the side of a continuing wall, or may be designed to be both safe and aesthetic. 3. A ramp shall have a surface which is non - slippery. 4. A ramp shall have a level platform at an entrance or exit which is at least 5 feet by 5 feet; if.a door swings out on the platform or toward the ramp. This platform shall extend at least 1 foot beyond each side .of the doorway. 5. A ramp shall have a level platform at least 3 feet deep and 5 feet wide, if the door does.not swing -5- D. Facilities for Handicapped 1. In every building or-public-accomodation where toilets are pro vided;excep.t in dwelling - units, there shall be at least one water closet for: each sex which is:accessibl -e Lnto out the platform toward tole ramp. This platform shall extend at least 1 foot. beyond each side of the doorway. .6. Each ramp shall have at least 6 feet of straight clearance at the bottom. 7. Ramps shall.have level platforms at no more than 30 foot intervals for purposes of rest and safety and shall have level platforms wherever they turn. C. Places of Assembly 1. Such places of assembly shall provide a clear space in the assembly units for individuals in wheel chairs; 2. These spaces shall be located so as not to interfere- with egress from any row of seats; 3. Places of assembly with fixed seating arrangements shall provide viewing positions for individuals in wheel chairs in accordance with the following schedule: "Capacity of Number of Assembly Spacer Viewing Spaces :. Up to 50 seats: 2 spaces 51 to 400 seats: 4 spaces 401 or more seats: An even number of spaces not less than 1% of total .. seats . " D. Facilities for Handicapped 1. In every building or-public-accomodation where toilets are pro vided;excep.t in dwelling - units, there shall be at least one water closet for: each sex which is:accessibl -e to the handicapped. There shall be at least one such water closet for each sex for every 500 occupants. The toilet.stall shall be at least 3'6" wide by 6' in depth, having 'a clear 32" opening and .a door (if used) which swings out. The water closet in this one stall shall be set 19 inches above the floor. The stall shall be provided with grab bars on each side. The grab bars shall have an outside diameter of I2" and shall be 33" above' and parallel to the floor, with 12" clearance from the wall. 2. Toilet rooms for men shall have a wall mounted urinal with the opening of the basin 19" (nineteen) from the floor, or .shall have floor mounted urinals that are level with the main,floor of the toilet room. 3. A shelf, disposal unit, or the lower edge of a mirror shall not be more than 40" (forty) above the floor. A towel, and /or sanitary napkin dispenser (paper level) or electric hand dryer shall not be more than 48" (forty - eight) above the floor. E. Drinking Fountains Where drinking fountains are provided in buildings, five (5) percent or not less than one drinking fountain per floor shall be located not more than 36" above the floor. Measurements shall be to top of basin. -7- F.. Elevators 1. All buildings of two or more stories shall require elevators with emergency hold open buttons and emergency communications no higher.than 4 feet from the floor. 'The floor and control buttons shall be located not more than 60" (sixty) above the floor. a. If independent and- safe access to all floors by individuals confined to wheelchairs has not been accounted for in an acceptable manner prescribed within this Standard, b. If floor levels, other than the.one(s) that is directly accessible to, and usable by, individuals in wheelchairs,�ontain facilities, services,.or functions intended for the general public, essential to the general public, or of broad interest to' the general public. C. If levels, other than the one(s) that is di.,rectly accessible to, and usable by, individuals in wheel- chairs, encompass facilities, services or functions of interest to the general public which are not duplicated on accessible, and usable, floor levels, and d: If the area of an otherwise inaccessible floor is more than one thousand square feet. 2. Elevators shall be accessible to, and usable by; handicapped persons on the level that they use to enter the building and at all le'els normally used by the general public. 3. Elevators shall.allow` for traffic by wheel chairs in accordance with III -F.1. a;b,c'a'nd. d.. G. Public Phones Where a public or pay phone is installed, the following shall apply. Five (5) percent or not less than one telephone shall be accessible to, and usable by, physically. handicapped persons. Such-telephones shall have the dial, coin slot, and handset not more than 54 inches above the floor. H. Hazardous Exits Doors opening into mechanical or electrical equipment rooms shall be equipped with locks. I._ Parking Areas Two percent of all required parking spaces shall be provided for the handicapped and the parking stall width shall be a minimum of 12 feet wide and be identified by a vertically mounted permanent sign. The elevation from the parking lot to an entrance designated for the handi- capped shall be ramped to facilitate easy access. IV. Violations A. Penalty Any person, firm or corporation who. violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than twenty -five (25) dollars ME nor morethan two - hundred (200) doll rs for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. B. Validity Should any section, clause or provision of this ordinance be declared by the Courts to be invalid, the same shall not effect the validity'of the ordi.nance as a whole or any part thereof, other than the part so declared to be invalid.
