O-23-13VILLAGE OF DEERFIELD ORDINANCE NO. 2023- 0-23-13 AN ORDINANCE AMENDING SECTION 7-15 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, REGARDING PEDDLERS AND SOLICITORS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, the Village has established regulations for soliciting and peddling within the Village in Article 2 of Chapter 7 ("Regulations') of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'; and WHEREAS, the President and Board of Trustees have determined that the Regulations should be updated so that they appropriately protect First Amendment freedoms while also protecting the well-being, tranquility, and privacy of the residents of the Village; and WHEREAS, the proposed updated Regulations are narrowly tailored to protect against crime and public safety risks that may arise from door-to-door solicitation and against burdens on the Village's resources beyond its capacity to bear, without burdening more speech than is necessary to further these legitimate governmental interests; and WHEREAS, the President and Board of Trustees thus have determined that it is appropriate and in the best interests of the Village and its residents to amend the Regulations as provided in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: AMENDMENT TO SECTION 7-15 OF THE VILLAGE CODE. Section 15, titled "License of Peddlers and Commercial Solicitors," of Article 2, titled "Peddlers and Solicitors," of Chapter 7, titled "Businesses," of the Village Code is hereby amended and shall read as follows: {00132 "Sec. 7-15. License Of Peddlers And Commercial Solicitors: (a) License Required: Every person engaging in the business of peddling or commercial soliciting must obtain a license from the village as hereinafter provided. The application shall set forth the information contained in subsection (b) of this section. Additions are bold and double -underlined; de4et ans are struel- through (b) Application For License: Application for a license shall be made upon a form provided by the village clerk. The applicant shall truthfully state in full the information requested on the application: (00132511.21 (1) Name and address of present place of residence and length of residence at such address; business address if other than residence address; also social security number; (2) Address of place of residence during the past three (3) years, if other than present address; (3) Physical description of the applicant; (4) Name and address of the person by whom the applicant is employed or represents, and the length of time of such employment or representation; (5) Name and address of employer during the past three (3) years, if other than the present employer; (6) Description sufficient for identification of the subject matter of peddling or soliciting in which the applicant will engage; (7) Period of time for which the license is sought; (8) The date, or approximate date, of the latest previous application for license under this article, if any; (9) Whether a license issued to the applicant by the village or any other municipality has ever been revoked; (10) Whether the applicant has ever been convicted of a violation of any of the provisions of this article or ordinance of any other Illinois municipality regulating soliciting or peddling; (11) Evidence that the applicant is authorized to solicit for the organization represented; (12) Whether the applicant has been convicted of a felony within the preceding ten (10) years, or convicted of a misdemeanor or ordinance violation within the preceding five (5) years, and the nature of the offense. Additions are bold and double-underli-nQd; deletions ^n^ struck thy-ough. 2 13 Submit background check results from the Illinois State Police Bureau of Identification, which may done by submitting the results from a State -approved Livescan vendor to the Police Department, which results must have been issued by the vendor within the past 90 days prior to submission to the Village." SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect after passage, approval, and publication in the manner provided by law.
