ORDINANCE NO. 2022- 0-22-42
AN ORDINANCE AMENDING SECTION 9.01-B.9.B AND APPENDIX II
OF "THE VILLAGE OF DEERFIELD ZONING ORDINANCE 1978," AS AMENDED,
TO INCREASE THE ALLOWED DEPTH OF GROUND SIGNS
WHEREAS, the Village of Deerfield is a home rule municipal corporation in
accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970;
and
WHEREAS, the Village has the authority to adopt ordinances and to promulgate
rules and regulations that pertain to its government and affairs; and
WHEREAS, Section 9.01-B.9B and Appendix II of "The Village of Deerfield Zoning
Ordinance 1978," as amended ("Zoning Ordinance') limits the depth or the distance
between two sign faces on a ground sign to 12 inches ("Regulation'); and
WHEREAS, property owners desiring to install ground signs have found the
Regulation to make the installation of grounds signs that comply with the Regulation
difficult, as many ground signs need to have more depth to allow for effective lighting
equipment and structural supports to be installed in signs; and
WHEREAS, the Village desires to amend the Regulation to allow the depth or the
distance between two sign faces on a ground sign to be up to 18 inches ("Proposed
Amendment'); and
WHEREAS, on May 23, 2022, the Architecture Review Commission recommended
the adoption of the Proposed Amendment; and
WHEREAS, a public hearing by the Pl.;ni Commission to consider the Proposed
Amendment to the Zonin, Ordinance w.zs dull• advertised on October
I?ei'iow, and was held on October 27, 2022, and
WHEREAS, on October 27, 20= the Plan Commission approved findings of fact in
support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of
the Zoning Ordinance,_ and voted to recommend approval of the Proposed Amendment by the
Village Board; and
WHEREAS, the Village Board has considered the standards for amendments set
forth in Section 13.10 of the Zoning Ordinance; and
WHEREAS, the President and Board of Trustees have determined that it will serve
and be in the best interests of the Village to adopt the Proposed Amendment of the Zoning
Ordinance pursuant to this Ordinance;

NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND
BOARD OF TRUSTEES OF DEERFIELD, LAKE AND COOK COUNTY, ILLINOIS, as
follows:
SECTION ONE. RECITALS. The facts and statements contained in the preamble
to this Ordinance are found to be true and correct are hereby adopted as part of this
Ordinance.
SECTION TWO. AMENDMENT TO SECTION 9.01-B.9.B OF THE ZONING
ORDINANCE. Section 9.01-B, titled "Limitation on Signs," of Article 9, titled "Signs," of the
Zoning Ordinance is hereby amended and shall read as follows:
"9.01-B Limitation on Signs
The following provisions are applicable to all signs subject to the provisions of
this Article:
9. Limitation on the Orientation and Configuration of Sign Faces
b. Maximum Distances Between Sign Faces
The maximum distance allowed between two parallel or nearly parallel
sign faces shall not exceed t�•�2) 18 inches unless otherwise
specifically provided for in this Ordinance. If the maximum distance is
to exceed' -• 12,18 inches, a sign modification must be sought and
approved by the Board of Trustees. In such cases the areas of the two
open sides or two side panels shall be included in the computation of
the �Th�tilll'faCe aTG'�l Of the slc'n.
SECTION THREE. AMENDMENT TO APPENDIX II OF THE ZONING
ORDINANCE. Appendix lI of the Zoning Ordinance is hereby amended and shall read as
follows:

Maximum Distance Between Sign Faces — Article 9.01-B.9b
Note — Maximum distance permitted is 4418 inches.

SECTION FOUR. SEVERABILITY. If any provision of this Ordinance or part
thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this
Ordinance are to remain in full force and effect, and are to be interpreted, applied, and
enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the
greatest extent permitted by applicable law.
SECTION FIVE. PUBLICATION. The Village Clerk is hereby directed to publish
this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION SIX. EFFECTIVE DATE. This Ordinance will be in full force and effect
from and after its passage, approval, and publication in the manner provided by law.
