R-22-79VILLAGE OF DEERFIELD RESOLUTION NO. 2022- -22- 9 A RESOLUTION WAIVING BIDDING AND APPROVING AN AWARD OF CONTRACT TO AXON ENTERPRISE, INC. FOR ELECTRONIC CONTROL WEAPONS WHEREAS, the Village of Deerfield ("Village') is a home rule municipality in accordance with Article VII, Section 6 of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has budgeted sufficient funds in the 2023 fiscal year for the purchase of Electronic Control Weapons ("ECWs'); and WHEREAS, Axon Enterprise, Inc. ("Axon's submitted a proposal for the purchase and maintenance of the ECWs and the services necessary to maintain the operation of the ECWs in the amount of $119,585.79, with $23,916.91 for the first year (2023) and $23,917.22 annually thereafter (ending in 2027); and WHEREAS, the Village desires to enter into an agreement with Axon for the ECWs and expend $23,916.91 for year one and $23,917.22 for years two through five ("Agreement'); and WHEREAS, the Mayor and Board of Trustees have determined that waiving bidding and entering into the Agreement with Axon to provide ECWs will serve and be in the best interest of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Resolution as findings of the Village Board. SECTION TWO: WAIVER OF COMPETITIVE BIDDING. Pursuant to Section 9-16 of the Village Code and the Village's home rule authority, the Village Board waives the, requirement of competitive bidding for the purchase of the ECWs. SECTION THREE: APPROVAL OF AGREEMENT. Pursuant to the Village's home rule authority, the Agreement by and between the Village and Axon is hereby approved in substantially the form attached to this Resolution as Exhibit A. SECTION FOUR: AUTHORIZATION TO EXECUTE AGREEMENT. The Mayor and the Village Clerk are hereby authorized and directed to execute and attest, on behalf of the Village, the final Agreement upon receipt by the Village Clerk of at least one original copy of the final Agreement executed by Axon; provided, however, that if the executed copy of the final Agreement is not received by the Village Clerk within 60 days after the effective date of this Resolution, then this authority to execute and attest will, at the option of the Mayor and Board of Trustees, be null and void. BACKGROUND The Deerfield Police Department has utilized TASER brand Electronic Control Weapons (ECWs) since the original purchase in 2017. ECWs are less -lethal weapons meant to help control persons who are actively resisting authority and acting aggressively.
