O-74-03ORDINANCE NO. 0 -743.= 3 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 19 OF THE MUNICIPAL CODE OF DEERFIELD Published in pamphlet form this 7th day of January 1974, by the President and Board of Trustees of Deerfield. \ • ORDINANCE NO. 0 -74` 3 AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 19 OF- THE MUNICIPAL CODE OF DEERFIELD ' : BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section.19.210 of Article II of Chapter 19 ONE: of the Municipal Code of Deerfield of 1963, as amended, be and the same is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: 19.210 Vicious Dogs.) It shall be unlawful for any person to keep or otherwise maintain within the Village any dog which is known to be vicious or dangerous or which has evidenced a disposition to unprovokedly, attack human beings. Upon convic- tion of any person for a violation of this Section, he shall, subject to the provisions of Section 19.211, remove such dog from the'Village within 24 hours thereafter or within 24 hours after the period of observation for rabies has expired if applicable. Every day that such person fails to remove such dog shall constitute a separate offense. If such person fails to comply, then, upon 24 hours written notice to the owner, such dog shall be apprehended and removed from the Village by the person charged with the enforcement of this Article. SECTION That Section 19.211 of Chapter 19 of the Municipal TWO: Code of Deerfield of 1963, as amended, be and the same is hereby further amended.by striking said Section in its entirety and substituting in lieu thereof the following: 19.211 Dog Bites.) It skgll be the duty of the owner of any dog to prevent such dog from biting or attacking any person in the Village, and if a person is bitten by a dog he shall report the incident to the police department immediately.- Any dog which may unprovokedly bite or attack any person in the.Village is hereby declared to be a public nuisance and such dog may be apprehended and impounded by a police officer, animal warden, or other person charged with the enforcement of this Article. If an owner has notice that his dog has bitten any person, it shall be unlawful for such owner to kill such dog, or sell or give such dog away, or to permit or allow such dog to be taken beyond the limits of the Village except to a licensed veterinary hospital, but it shall be the duty of such owner to immediately report the incident to the police department and to immediately place such dog in a licensed veterinary hospital for observation and otherwise comply with the provisions of the Illinois Animal Control Act (Chapter -; , Section ^,,,, Illinois Revised Statutes). Prior to the release of such dog, the owner shall have the dog examined and shall furnish the police department with a certificate of a licensed veterinarian stating that such dog does not have rabies. All costs of maintaining such dog in a veterinary hospital shall be the obligation and responsibility of the owner and shall be paid by said owner: In all cases where any dog has bitten a person and is slain or dies within ten days from the time of the bite, it shall be the duty of the person slaying such dog and the owner of such dog to notify the police department and to immediately deliver the head of such dog intact to said department, or cause the same to be done. SECTION That Section 19.212 of Article II of Chapter 19 THREE: of the Municipal Code of Deerfield of 1963; as amended, be and the same is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: 19.212 Disturbing Quiet.) It shall be unlawful for an owner to keep, harbor or otherwise maintain within the Village a dog which shall unreasonably disturb the peace and quiet of any person or neighborhood. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form. SECTION That all ordinances or parts of ordinances in "FIVE: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shal•1 be in full force and SIX: effect from and after its passage, approval and publication as provided by law.
