AN ORDINANCE AMENDING CHAPTER 10 OF THE MUNICIPAL CODE OF
DEERFIELD BY STRIKING SECTIONS 10.204, 10.208 and 10.209
AND BY ADDING A NEW ARTICLE IIA "CONTRACTS"
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS
FOLLOWS:
SECTION That Chapter 10 of the Municipal Code of Deerfield
ONE: of 1963, as amended, be and the same is hereby
further amended by striking Sections 10.204, 10,208 and 10.209
thereof and adding a new Article IIA "Contracts" as follows:
ARTICLE IIA. CONTRACTS
10.201A. Contracts over $1,500.00
(a) Competitive Bids. Except as otherwise provided in
this Code, all contracts for public works or improvements
not to be paid for in part or in whole by special assessment
or special taxation when the expense thereof exceeds $1,500.00,
and all purchase orders or contracts of whatever nature for—
labor, services, materials, equipment or suppiies involving
amounts in excess of $2,000.00 made by or on behalf of the
Village shall be let by free and open.competitive bidding
after advertisement to the lowes.1- responsible bidder,
provided that such purchase. - orders or contracts may be
entered into brthe�-appropriate_ o- fficers if authorized by
the fiffirma -five vote 6f. -two- thirds (2/3) of the trustees
theT "holding office.
r (b) Contracts not requiring competitive bids. Contracts
which by their nature are not adapted to award by com-
petitive bidding such as but not limited to contracts
for the services of individuals possessing a high degree
of professional skill where the ability or fitness of
the individual plays an important part, contracts for
supplies., materials, parts or equipment which are avail-
able only from a single source, or other similar contract
may be entered into without competitive bidding upon the
affirmative vote of two thirds (2/3) of the Board of
Trustees. Competitive bidding shall not be required when
the Village exercises the option of purchasing with the
State or other governmental unit as authorized under
Illinois Revised Statutes, Chapter 85 -1601, et sec.
10.202A. Notice :Inv.iting Bids'.)
(a) Newspaper.. Notice inviting bids shall be 'published
once.:in.at :least 'one newspaper. published or of general
circulation in the :Village :and .at .least ten (10).
days preceding thb :last day set :for. the '.receipt of
proposals. The newspaper. noti.ce..shall include '.a general
description of th.e` articles or services: to'. be:purchased,
shall .state.where bid forms and specifications may be
secured, and th:e time and place for opening bids.
(b.). Bidders' List.. The :Village Manager. shall also
solicit sealed bids from all responsible prospective .
suppliers or contractors who have .req.ue.ste'd their
names: to. be, .added to: a "Bidders' List ": which. :the Village
Manager. shall maintain, by sending them a copy of such
newspaper. notice. '.or such. :other. notice :as will acquaint :
them with :th:e :proposed purchase or contract..'.
(c). Bulletin Board. The Village Manager. shall also
adverti:se.all. pending purchases :or bid awards by a
noti:ce.:posted on the public bulletin board in the
Village Hall.
10:203A. Bid.Depos.its:) In all cases. of contracts" for
public works or improvements: and in all cases when the
estimated .cost exceeds $ ' and i.n , all other.
cases. when deemed advisab. e by. the :Village Manager., bid
depos.ita or bid bonds shall be. 'required in an amount equal

10:.204A., Bids, Affidavit to Accompany) In addition to
all .other..cer.titicates and affidavits: as may be 'required
by th:e Board of Trustees and Village Manager and prescribed
in the .public notices inviting bids, all'bids shall be
accompanied by. the sworn affidavit of thb bidder. or a duly
authorized agent:or officer. of the bidder: containing,.in
substance.,. the :following affirmations:
(a) The. 'Said bidder has not :entered into. any agreement,.
understanding or arrangement with: :any . other . bidder: or
prospective bidder, or with any .other.person, firm or
corporation capable :of being a prospective bidder.
relating to. the '.price. named in said bid proposal or any
other. proposal, nor any agreement,: understanding or
arrangement:under . which.any person, firm or corporation
is to refrain from bidding, nor any agreement,. understanding

or arrangement for any act or omission in restraint of
free competition among bidders in violation of the
Illinois Anti Trust Act (Chapter 38, Section 60 -1,
et se q, Illinois Revised Statutes) or the Federal Anti
Trust Laws (U.S. Code, Title 15,_Section 1, et sec) or
other applicable law or regulation prohibiting collusion
among bidders in restraint of freedom of competition;
(b) The said bidder is not disqualified by law from
contracting with the Village of Deerfield;
(c) The said bidder has not disclosed to any person, firm
or corporation described in Subparagraph a above the terms
of said proposal or the price named therein;
(d) The said bidder, if awarded the contract during.
the term thereof, will not commit an unfair employ-
ment practice as defined in the Illinois Fair Employ-
ment Practices Act (Chapter 48, Section 851, et sec,
Illinois Revised Statutes) nor violate the provisions
of "AN ACT to prohibit discrimination and intimida-
tion on account of race or color in employment con-
tracts for public buildings or public works (Chapter
29, Sections 17 through 24, Illinois Revised Statutes)
or any other applicable Federal, State or,Village law
or ordinance prohibiting discrimination among employees
or prospective employees because of race, color,
religion, sex, national origin or ancestry;
(e) The failure of a bidder to submit such a-sworn
statement with his bid shall disqualify his bid from
consideration for an award of the contract.—I12-.th.,e._._..__....,

10.205A. Bid Opening Procedure)
(a) Sealed. Bids shall be submitted sealed to the
Village Manager and shall be identified as bids on
the envelope.
(b) Opening. Bids shall be opened in public at the
time and place stated in the public notices and shall

thereupon be referred for review, tabulation and recom-
mendation to the appropriate Village officer, department
head or consultant who shall make a written report and
recommendation to the Board of Trustees.
(c) Tabulation. A tabulation of all bids received
shall be posted for public inspection.
10.206A. Rejection of Bids) The Board of Trustees shall
have the authority to reject all bids, parts of all
bids, or all bids for any one or more supplies or con-
tractual services included in the proposed contract
when the public interest will be served thereby. Bids
which do not conform to the bid forms provided or are
substantially incomplete or are otherwise vague or
uncertain may be rejected provided that minor omissions
or errors not affecting the bid amount may be corrected.
10.207A. Bidders in Default to Village) The Board of
Trustees shall not accept the bid of a contractor or
a supplier who is in default on the payment of taxes,
licenses or other monies due the Village.
10.208A. Award of Contract)
(a) Authority. The Board of Trustees shall have the
authority to award contracts required under the terms
of this Code to be let by competitive bidding and
such contracts shall be in writing and signed by the
President and Clerk or such other persons as may -be
authorized by the Board.of Trustees.
(b) Lowest Responsible Bidder. Contracts shall be
awarded to the.ldwest responsible bidder. In deter -
mining "lowest responsible bidder," in addition to
the -bid amounts the Board.of Trustees shall consider:
(1) The ability, capacity and skill of the bidder
to perform the contract or provide the service
required;
(2) Whether the bidder can perform the contract or
provide the service promptly, or within the time
specified, without delay or interference;
(3) The character, integrity, reputation, judgment,
experience and efficiency of the bidder;
(4) The quality of performance of previous contracts
or services;
(5) The previous and existing compliance
with laws and ordinances relating to the
service;

of the financial resources and
to perform the contract or
(7) The quality, availability and adaptability
of the supplies, or contractual services to the par-
ticular use required;
(8) The ability of the bidder to provide future
maintenance and service for the use of the subject
of the contract;
(9) The number and scope of conditions attached
to the bid.
(c) Award to Other Than Low Bidder) When the award
is not given to the lowest bidder, a full and com-
plete statement of the reasons for placing the order
elsewhere shall be prepared by the Village Manager and
filed with the other papers relating to the transaction.
(d) Tie Bids.
(1) Local vendors. If all bids received are for the
same total amount or unit price, quality and service
being equal, the contract shall be awarded to a
local bidder;
(2) Outside vendors. Where subsection (1) is not
in effect, the Board of Trustees or the Village Manager
shall award the contract to one of the tie bidders ' '

10.209A., Contragt- S—Brid6r $1,500.00) All contracts
for public.w6rks or improvements not to be paid for
in-- part4or in whole by special assessment or special
taxation involving an amount less than $1,500.00 and
all purchases of supplies, and other contractual
services of less than the estimated value of $2,000.00
may be made by the Village Manager or person designated
by him in the open market, without newspaper advertisement
and without observing the procedure prescribed in Sections
10.201A and 10.208A, as long as said contract price does
not result in exceeding the amounts authorized therefor
in the Annual Budget.
(a) Procedure. The Village Manager shall promulgate
rules and procedures providing for the issuance of
purchase orders and awarding of contracts which, by
the terms of this Code, are under his jurisdiction.
Such rules shall govern those persons to whom

the authority to purchase and contract is delegated by the Village
Manager. Where practical, all open market purchases shall be based
on at least three competitive quotes, and shall be awarded to the
person, firm or corporation submitting the lowest responsible
quotation in accordance with the standards set forth in Section
10.208A.
(b) Recording. The Village Manager shall keep a record of all
open market orders and contracts and a record of the bids, if
any, submitted in competition thereon, and such records shall
also be open to public inspection.
10.210A. Assignability of Contracts) No contract awarded in the
manner herein provided shall be assignable by the successful
bidder without the written consent of the Village Manager, if the
amount of the contract is less'than $1,500.00 or the approval of
the Board of Trustees in the event the amount of the contract is
$1,500.00 or more.
10.211A. Bond Required, Contracts for Public Works)
(a) All contracts for public works of any kind to be performed
for the Village shall require every contractor for such work to
furnish a surety bond, which bond, among other conditions, shall be
conditioned upon the completion of the contract, the payment of
all material used in such work and the payment of all labor per-
formed in such work whether by subcontractor or otherwise, in
accordance with the prevailing wage rates, and upon the performance
of such work in accordance with the plans and specifications and
the terms of such contract.
10.212A. Bonds) Where required under the provisions of this
Article, bond may be given in the form of a cashier's or
certified check or the bond of the bidder, contractor or
vendor as the case may be with surety which shall be a company
licensed by the Department of Insurance of the State of Illinois
and which shall have not less than an AAAA rating by Best's or
other established rating service.

10.211A. Bond Required, Contracts .for Public Works)
(a) All contracts for public works of any kind tou�
be performed for the Village shall require every

the Village a surety bond, which bond, among other
conditions, shalIA- 4onditioned upon the -compldtion
of the contract, the payment of all material used
in such work and the payment of all labor per�ormed
in such work whether by sub - contractor or otherwise,
in accordance with the prevailing wage rates, and
upon the performance of such work in accordance
with plans and specifications and the terms of
such contract.
10.212A. Bonds) Where required under the provisions
of this Article, bond may be given in the form of a
cashier's or certified check or the bond of the
bidder, contractor or vendor as the case may be with
surety which shall be a.company licensed by the
Department of Insurance of the State of Illinois
and which shall have not less than an AAAA rating by
Best's or other established rating service.
SECTION That the Village Clerk is hereby directed to
TWO: publish this Ordinance in pamphlet form.
SECTION That all ordinances or parts of ordinances in

conflict,: hereby repealed.
